House Bill 1788

AN ACT TO ADD CERTAIN AREAS TO THE BOUNDARIES OF THE EAST LEFLORE COUNTY WATER AND SEWER DISTRICT AND TO AUTHORIZE THE DISTRICT TO PROVIDE WATER AND SEWER SERVICES TO THOSE AREAS; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) In addition to the area within the boundaries and within one (1) mile of those boundaries of the East Leflore County Water and Sewer District, Leflore County, Mississippi, the following described areas of Leflore County, Mississippi, are added to the area of the district:

(a) A tract of land located in the Northeast Quarter of Section 10, Township 19 North, Range 1 West, Leflore County, Mississippi, described as follows:

Beginning at the Southeast corner of the Northeast Quarter of said Section 10; thence run West a distance of 1,320 feet to the Southwest corner of the Southeast Quarter of the Northeast Quarter of said Section 10; thence run North a distance of 1,320 feet to the Northwest corner of the Southeast Quarter of the Northeast Quarter of said Section 10; thence run East a distance of 1,320 feet to the Northeast corner of the Southeast Quarter of the Northeast Quarter of said Section 10; thence run South a distance of 1,320 feet to the said Point of Beginning of the herein described parcel of land.

(b) A part of Sections 30 & 31, Township 20 North, Range 3 East, Leflore County, Mississippi, described as follows: Beginning at the Northwest corner of the Southeast Quarter of the Northwest Quarter of said Section 30; thence run East one-half mile to the Northeast corner of the Southwest Quarter of the Northeast Quarter of said Section 30; thence run South one mile to the Southeast corner of the Northwest Quarter of the Northeast Quarter of said Section 31; thence run West one-half mile to the Southwest corner of the Northeast Quarter of the Northwest Quarter of said Section 31; thence run North one mile to the said Point of Beginning of the herein described parcel of land.

(c) Frederick Subdivision, as described and shown on the map of said subdivision recorded in Plat Book 4 at page 39 of the Map Records of Leflore County, Mississippi.

(d) Chapman Subdivision, as described and shown on the map of said subdivision recorded in Plat Book 5 at page 9 of the Map Records of Leflore County, Mississippi.

(e) Second Chapman Subdivision, as described and shown on the map of said subdivision recorded in Plat Book 5 at page 33 of the Map Records of Leflore County, Mississippi.

(f) Woodhaven Subdivision Part One, as described and shown on the map of said subdivision recorded in Plat Book 5 at page 40 of the Map Records of Leflore County, Mississippi.

(2) Subject to the provisions of subsection (3) of this section, the Board of Commissioners of the East Leflore County Water and Sewer District, Leflore County, Mississippi, in its discretion, and upon resolution duly adopted and entered upon its minutes, may expand its water and sewer services to those areas described in subsection (1) of this section. In providing services to those areas, the district may exercise the same authority and perform the same acts as the district does in the provision of water and sewer services to other areas served by the district.

(3) Before expanding its water and sewer services to any area described in subsection (1) of this section, the Board of Commissioners of the East Leflore County Water and Sewer District shall obtain a certificate of public convenience and necessity from the Public Service Commission as required under Chapter 3, Title 77, Mississippi Code of 1972.

SECTION 2. This act shall take effect and be in force from and after its passage.
