AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF TALLAHATCHIE COUNTY TO EITHER LEASE WATER TANKS OR WELLS OWNED BY THE COUNTY OR ENTER INTO AN AGREEMENT FOR OPERATION OF THE WATER TANKS OR WELLS OWNED BY THE COUNTY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Board of Supervisors of Tallahatchie County, in its discretion, may lease the water tank, water well or water wells owned by the county to the North Tallahatchie Water Association, for a period up to forty (40) years and for such sums and on such conditions as the board deems proper, and as the Board of Supervisors of Tallahatchie County finds will improve water service to its residents and improve the general welfare of its citizens; or

     (2)  The Board of Supervisors of Tallahatchie County, in its discretion, may enter into an operating agreement with the North Tallahatchie Water Association, Inc., to operate the water tank, water well or water wells owned by Tallahatchie County for a period of time up to forty (40) years and on such terms and conditions that allow the North Tallahatchie Water Association, Inc., to operate the water tank, water well or water wells owned by Tallahatchie County.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
