AN ACT TO AUTHORIZE THE BOARD OF TRUSTEES OF STATE INSTITUTIONS OF HIGHER LEARNING, BY AND THROUGH THE DEPARTMENT OF FINANCE AND ADMINISTRATION, TO CONVEY CERTAIN STATE-OWNED REAL PROPERTY LOCATED IN WASHINGTON COUNTY, MISSISSIPPI, TO THE BOARD OF TRUSTEES OF MISSISSIPPI DELTA COMMUNITY COLLEGE; TO REQUIRE THE BOARD OF TRUSTEES OF MISSISSIPPI DELTA COMMUNITY COLLEGE TO CARRY OUT CERTAIN FUNCTIONS RELATIVE TO THE MANAGEMENT AND OPERATION OF THE GREENVILLE HIGHER EDUCATION CENTER; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The State of Mississippi, acting through the Department of Finance and Administration and on behalf of the Board of Trustees of State Institutions of Higher Learning, is authorized to convey to the Board of Trustees of Mississippi Delta Community College, for the use and benefit of the Greenville Higher Education Center, the following real property in Washington County, Mississippi:

40.00 acres, more or less, located in Sections 13 and 14, Township 17 North, Range 8 West, Washington County, Mississippi, and being more particularly described as follows:

Commence at a 3/4" iron pipe in concrete on the corner common to Sections 13, 14, 21, and 22, Township 17 North, Range 8 West, Washington County, Mississippi; thence North 00 degrees 00 minutes 06 seconds West along the line common to said Sections 13 and 14, 1,320.04 feet to a 2" iron pipe; thence continue North 00 degrees 00 minutes 06 seconds West along said common line between Sections 13 and 14 - 2035.67 feet to the Point of Beginning of the parcel herein described; thence North 85 degrees 39 minutes 30 seconds West 564.05 feet to a 4/8" iron rod set on the east right-of-way line of U.S. Highway No. 1; thence along the east right-of-way line of U.S. Highway No. 1, North 04 degrees 20 minutes 30 seconds East 896.27 feet to a concrete right-of-way marker; thence continue along said right-of-way line, North 04 degrees 20 minutes 30 seconds East 103.73 feet to a point on the south right-of-way (40 feet from the centerline) of Archer Range Road; thence along the south right-of-way line of Archer Range Road, North 80 degrees 58 minutes 54 seconds East 1,081.32 feet; thence continue along said south right-of-way line of Archer Range Road, North 82 degrees 53 minutes 40 seconds East 464.37 feet; thence South 837.90 feet to the north right-of-way line of an ANR Pipeline Company easement; thence along said north right-of-way line of the ANR Pipeline easement, South 39 degrees 15 minutes 23 seconds West 517.71 feet; thence North 85 degrees 39 minutes 30 seconds West 653.02 feet to the Point of Beginning, together with all improvements situated thereon and all appurtenances thereunto belonging, LESS AND EXCEPT all easements and rights-of-way of record.

     SECTION 2.  (1)  The Board of Trustees of Mississippi Delta Community College shall be responsible for the management and upkeep of the above-described property, as well as any facilities thereon and any improvements that may at some future date be constructed on the site.  The board of trustees shall enter into any contracts necessary with Delta State University, Mississippi Valley State University, or any other agency or governing authority of state or local government or any private entity, to ensure that appropriate fees are paid to the Greenville Higher Education Center for the use of the facility.

     (2)  The Board of Trustees of Mississippi Delta Community College shall ensure that the Greenville Higher Education Center carries out the purposes assigned in Section 18, Chapter 538, Laws of 1997.  The Department of Finance and Administration and the institutions of higher learning are authorized to convey the above described property on the condition that it shall be used for the purposes provided for in this act, and further provided that the property shall revert to the state in the event that the Board of Trustees of Mississippi Delta Community College fails to operate the center as provided for in this act.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2007.
