House Bill 1057

AN ACT TO PROVIDE THAT ANY AUTOMOBILE INSURANCE POLICY THAT ALLOWS FOR THE USE OF OTHER THAN ORIGINAL EQUIPMENT MANUFACTURER PARTS IN THE REPAIR OF DAMAGED VEHICLES MUST HAVE THE PROVISION OF THE POLICY PROVIDING FOR THE USE OF SUCH PARTS PRINTED IN A CONSPICUOUS FONT IN BOLD PRINT AND IN NO LESS THAN TWELVE-POINT TYPE; TO PROVIDE THAT A POLICY ALSO MUST INCLUDE A SEPARATE FORM TO BE SIGNED BY THE INSURED INDICATING WHETHER HE RECEIVED NOTICE OF SUCH PROVISION OF THE POLICY; AND FOR RELATED PURPOSES. 

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  For any policy that allows for the use of other than original equipment manufacturer parts in the repair of damaged vehicles, the provision of the policy providing for the use of such parts must be printed in a conspicuous font in bold print and in no less than twelve-point type.  Such a policy also shall include a separate form which must be signed by the insured indicating whether he was provided notice of the other than original equipment manufacturer parts provision of the policy.

     SECTION 2.  Section 1 of this act shall be codified as a separate code section in Chapter 11, Title 83, Mississippi Code of 1972.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2007.
