AN ACT TO AMEND SECTION 19-5-15, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE BOARD OF SUPERVISORS OF ANY COUNTY TO USE COUNTY EQUIPMENT AND EMPLOYEES TO BURY DEAD LIVESTOCK ON PROPERTY OWNED BY OR PROVIDED BY THE OWNER OF THE LIVESTOCK WITHOUT THE REQUIREMENT FOR A FINDING THAT SUCH BURIAL IS NECESSARY TO PREVENT THE SPREAD OF A CONTAGIOUS DISEASE AMONG OTHER LIVESTOCK OF THE COUNTY; TO EXCLUDE COMMERCIAL LIVESTOCK OPERATIONS FROM THE AUTHORITY GRANTED UNDER THIS ACT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 19-5-15, Mississippi Code of 1972, is amended as follows:

     19-5-15.  (1)  The boards of supervisors of the several counties of this state, in their discretion, may use the road equipment of the counties and county employees to dig graves for the burying of dead livestock if the graves are upon the premises of the owner of the livestock or upon property provided by the owner.

     (2)  The authority granted under subsection (1) of this section shall not be applicable to commercial livestock operations.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2007.
