AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION AND THE MISSISSIPPI DEPARTMENT OF HEALTH TO PURCHASE CERTAIN REAL PROPERTY LOCATED IN RANKIN COUNTY, MISSISSIPPI, KNOWN AS THE "LAWS CONSTRUCTION" PROPERTY AND CERTAIN REAL PROPERTY, KNOWN AS THE "PUCKETT LABORATORY" PROPERTY, LOCATED IN LAMAR COUNTY, MISSISSIPPI, OR OTHER SUITABLE PROPERTY IN THE HATTIESBURG, MISSISSIPPI, AREA FOR THE USE AND BENEFIT OF THE DEPARTMENT OF HEALTH; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Mississippi Department of Health, acting through the Department of Finance and Administration, in its discretion, may purchase, for the use and benefit of the Department of Health, from Laws, LLC, a warehouse and associated lands located in Rankin County, Mississippi, described as follows:

PARCEL 1

A Parcel of land situated in the Northwest Quarter (NW 1/4) of the Southwest Quarter (SW 1/4) of Section 33, Township 6 North, Range 2 East, Rankin County, Mississippi, and being more particularly described as follows:

A certain parcel of land being situated in the Northwest 1/4 of the Southwest 1/4 of Section 33, T6N-R2E, City of Flowood, Rankin County, Mississippi, and being more particularly described as follows:

Commence at the Southwest corner of the Northwest 1/4 of the Southwest 1/4 of said Section 33 and run thence North 00 degrees 00 minutes 26 seconds East along the East right-of-way line of Mangum Road (as now laid out and improved) for a distance of 959.85 feet; leaving said East right-of-way line of Mangum Road, run thence North 89 degrees 59 minutes 08 seconds East for a distance of 310.67 feet to a point on the South right-of-way line of River Pines Drive (as now laid out and improved); leaving said South right-of-way line of River Pines Drive, run thence North 00 degrees 01 minutes 13 seconds East for a distance of 50.00 feet to a point on the North right-of-way line of said River Pines Drive; run thence along said North right-of-way line of River Pines Drive the following bearings and distances:  North 89 degrees 59 minutes 08 seconds East for a distance of 211.48 feet to the Point of Curvature of a 5.58972 degree curve bearing to the left having a central angle of 02 degrees 53 minutes 10 seconds and a radius of 975.00 feet; run thence along the arc of said curve a chord bearing of North 87 degrees 06 minutes 51 seconds East and a chord distance of 48.50 feet to the Point of Reverse Curvature of a 5.87639 degree curve bearing to the right having a central angle of 92 degrees 50 minutes 10 seconds and a radius of 1,025.00 feet; run thence along the arc of said curve a chord bearing of North 87 degrees 07 minutes 30 seconds East and a chord distance of 51.37 feet to the Point of Tangency of said curve; run thence North 89 degrees 59 minutes 08 seconds East for a distance of 339.10 feet to the POINT OF BEGINNING of the parcel of land herein described; from said POINT OF BEGINNING and leaving said North right-of-way line of River Pines Drive, run thence North for a distance of 315.05 feet; run thence North 89 degrees 52 minutes 12 seconds East for a distance of 139.68 feet; run thence South for a distance of 290.59 feet to a point on the aforesaid North right-of-way line of River Pines Drive; said point also being on the arc of a 114.59167 degree curve bearing to the left having a central angle of 54 degrees 16 minutes 26 seconds and a radius of 50.00 feet; run thence along said North right-of-way line of River Pines Drive and along the arc of said curve a chord bearing of South 57 degrees 07 minutes 26 seconds West and a chord distance of 45.61 feet to the end of said curve; run thence South 89 degrees 59 minutes 08 seconds West along said North right-of-way line of River Pines Drive for a distance of 101.37 feet to the POINT OF BEGINNING, containing 43,382.9 square feet or 0.996 acres, more or less.

PARCEL 2

A Parcel of land situated in the Northwest Quarter (NW 1/4) of the Southwest Quarter (SW 1/4) of Section 33, Township 6 North, Range 2 East, Rankin County, Mississippi, and being more particularly described as follows:

From the Point of Beginning, run South 50 degrees 51 minutes 19 seconds West, 176.55 feet along the proposed Northerly right-of-way line of the above referenced project to a point marking the intersection of said proposed Northerly right-of-way line and the West line of said "Laws" tract;

Thence leaving said Northerly right-of-way line, run North 00 degrees 05 minutes 37 seconds East, 252.22 feet along said West line to the Northwest corner of said "Laws" tract;

Thence leaving said West line, run North 89 degrees 57 minutes 49 seconds East, 134.77 feet along the North line of the "Laws" tract to the Northeast corner of said "Laws" tract;

Thence leaving said North line, run South 00 degrees 42 minutes 22 seconds East, 140.87 feet to the POINT OF BEGINNING, together with all rights of entry and all abutters rights of access in, to, over, on and across the above described parcel.

LESS AND EXCEPT PARCEL 3

A Parcel of land situated in the Northwest Quarter (NW 1/4) of the Southwest Quarter (SW 1/4) of Section 33, Township 6 North, Range 2 East, Rankin County, Mississippi, and being more particularly described as follows:

From the Point of Beginning, run North 89 degrees 55 minutes 15 seconds West, 40.22 feet along a common line between the South line of said "Slawson" tract and the North right-of-way line of River Pines Drive (an unrecorded street), as it exist this date, (February, 2002) to a point marking the intersection of said common line and the proposed Northerly right-of-way line of the above referenced project;

Thence leaving said common line, run North 50 degrees 51 minutes 19 second East along said proposed Northerly right-of-way line, 101.38 feet to a point marking the intersection of said proposed Northerly right-of-way line and the East line of said "Slawson" tract;

Thence leaving said proposed Northerly right-of-way line, run South 00 degrees 05 minutes 37 seconds West, 39.38 feet along said East line to a point marking the intersection of said East line and said North right-of-way line of River Pines Drive (an unrecorded street), as it exists this date, (February, 2002).  Same being on the arc of a curve to the left;

Thence leaving said East line, run Southwesterly along said North right-of-way line of River Pines Drive and the arc of said curve to the left, 47.34 feet to the POINT OF BEGINNING, together with all rights of entry and all abutters rights of access in, to, over, on and across the above described parcel.  Said curve to the left having a radius of 50.00 feet, a central angle 54 degrees 14 minutes 45 seconds, and a chord bearing and distance of South 57 degrees 14 minutes 13 seconds West, 45.59 feet.

     (2)  The Mississippi Department of Health, acting through the Department of Finance and Administration, in its discretion, may purchase, for the use and benefit of the Department of Health, the Puckett Laboratory Building and associated lands located in Lamar County, Mississippi, described as follows:

A Parcel of land situated in the Southeast Quarter (SE 1/4) of the Southeast Quarter (SE 1/4) of Section 12, Township 4 North, Range 14 East, Lamar County, Mississippi, and being more particularly described as follows:

A part of the Southeast Quarter of the Southeast Quarter (SE 1/4 of the SE 1/4) of Section 12, Township 4 North, Range 14 West, in the City of Hattiesburg, County of Lamar, State of Mississippi, and being more particularly described as commencing at the Southeast corner of the said Southeast Quarter of the Southeast Quarter (SE 1/4 of the SE 1/4) and thence run North 01 degree West along the East line of said Forty for 399.58 feet, thence run West for 386.22 feet to and for the Point of Beginning, thence continue West for 136.7 feet, thence run Westerly along a curve to the left having a central angle of 19 degrees 00 minutes 34 seconds and a radius of 479.39 feet for a distance of 159.05 feet to a point on the Northern boundary of Kensington Woods Second Addition, thence run North 66 degrees 44 minutes 42 seconds West along the Northern boundary line of Kensington Woods Second Addition for 239.02 feet, thence run North 00 degrees 18 minutes 41 seconds West for 384.22 feet to the South line of Mamie Street Extension, thence run North 89 degrees 49 minutes East along the South line of Mamie Street Extension for 507.3 feet to a point which bears North 0 degrees 54 minutes 54 seconds West from the Point of Beginning, thence run South 0 degrees 54 minutes 54 seconds East for 455.42 feet to the Point of Beginning, and comprising 5.25 acres, more or less.

     (3)  The Mississippi Department of Health, acting through the Department of Finance and Administration, in its discretion, may purchase, for the use and benefit of the Department of Health, any other suitable property in the Hattiesburg, Mississippi, area.

     (4)  Any monies in the State Treasury credited to the Department of Health, may be used to purchase the properties described in this section.

     (5)  Upon a determination by the Department of Health to sell the properties purchased in paragraphs (1) and (2) of this section, no final sale shall occur without consultation with the Department of Finance and Administration and the Chairmen of the Senate and House Public Property Committees.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
