AN ACT TO CREATE THE CRIMINAL OFFENSE OF USING A TASER IN THE COMMISSION OF A CRIME; TO PROVIDE PENALTIES FOR VIOLATIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Any person who uses a taser or other energy device that can stop a human being in the commission of any crime or in resisting arrest shall be guilty of a felony and, upon conviction, shall be punished by a fine of not more than Five Thousand Dollars ($5,000.00) or by imprisonment for not more than five (5) years, or both.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2007.
