AN ACT TO PROVIDE THAT THE STATE DEPARTMENT OF HEALTH AND THE COUNTY HEALTH DEPARTMENTS SHALL PROVIDE TO THE PARENT OR GUARDIAN OF A MINOR CHILD, UPON REQUEST, INFORMATION ABOUT HEALTH CARE TREATMENTS, PROCEDURES OR SERVICES PROVIDED TO THE CHILD BY THE STATE DEPARTMENT OR THE COUNTY HEALTH DEPARTMENTS, WITH CERTAIN EXCEPTIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The State Department of Health and the county health departments shall provide to the parent or guardian of a minor child, upon the request of the parent or guardian, medical information about health care treatments, procedures or services provided to the child by the state department or the county health departments.  However, the state department and the county health departments shall not be required to provide any information to the parent or guardian that would be in violation of the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA), or if the information relates to a health care treatment, procedure or service that a minor is authorized by state law to obtain from the state department or county health departments without the consent or knowledge of the parent or guardian.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2007.
