AN ACT TO AMEND SECTION 83-3-24, MISSISSIPPI CODE OF 1972, TO PROHIBIT THE MISSISSIPPI RATING BUREAU FROM CHANGING THE FIRE PROTECTION CLASSIFICATION FOR ANY MUNICIPALITY OR FIRE DISTRICT SOLELY BECAUSE OF THE AGE OF ITS FIRE TRUCK; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 83-3-24, Mississippi Code of 1972, is amended as follows:

     83-3-24.  When rating a municipality or fire district, the Rating Bureau shall consider the mileage, condition and maintenance of the fire truck rather than the age of such fire truck.  The Rating Bureau shall not change the fire protection classification for any municipality or fire district solely because of the age of its fire truck.  The guiding factor for changing the fire protection classification shall be based on a true cost benefit analysis performed by the local jurisdiction comparing maintenance cost versus replacement cost of the fire truck.  Such analysis shall use the National Fire Protection Association (NFPA) standards in the 1900 series for service tests.  For the purpose of grading fire departments, the alternative water supply standard shall be two hundred fifty (250) gallons per minute for a sustained period of one (1) hour.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
