Senate Bill 2846

AN ACT TO PROHIBIT INSURERS FROM ISSUING OR DELIVERING IN THIS STATE ANY HOMEOWNERS' INSURANCE POLICY, UNLESS THE POLICY IS WRITTEN IN SIMPLIFIED LANGUAGE AND APPROVED BY THE COMMISSIONER OF INSURANCE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.   (1)  An insurer may not issue or deliver in this state any homeowners' insurance policy, unless the policy is:

          (a)  Written in simplified language; and

          (b)  Approved by the Commissioner of Insurance as complying with the simplified language standards adopted under rules and regulations promulgated by his office. 

     (2)  The commissioner shall adopt rules and regulations to establish simplified language standards for homeowners' insurance policies.  

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2006.
