AN ACT ENTITLED THE "STUDENT AND FAMILY PRIVACY PROTECTION ACT OF 2006"; TO REQUIRE SCHOOL DISTRICTS TO INFORM THE PARENT OR LEGAL GUARDIAN OF THEIR RIGHT UNDER THE NO CHILD LEFT BEHIND ACT TO REQUEST THAT THE HIGH SCHOOL STUDENT'S NAME NOT BE RELEASED TO MILITARY RECRUITERS WITHOUT PRIOR WRITTEN CONSENT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  This act shall be known and may be cited as the "Mississippi Student and Family Privacy Protection Act of 2006."

     (2)  Any school district that requires the parent or guardian of a high school student to provide current emergency information to the pupil's school of attendance shall include a notice in the emergency information request form that does all of the following:

          (a)  Informs the parent, legal guardian and student of his or her right to request pursuant to Section 7908(a)(2) of the United States Code Ann. (the No Child Left Behind Act of 2001), that the student's name, address and telephone listing not be released to military recruiters without the prior written consent of the parent, legal guardian or student if eighteen (18) years of age or older; and

          (b)  Allows the parent, legal guardian or student to indicate on the request form that he or she chooses to make the request specified in paragraph (a).

     (3)  A request pursuant to this section shall not prohibit a school district from releasing pupil information to postsecondary educational institutions or prospective employers.

     (4)  A notice required by this section shall be provided in English and in whatever other language a school district uses in its request for emergency information to the parent or legal guardian.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2006.
