A CONCURRENT RESOLUTION SUSPENDING THE DEADLINES FOR THE PURPOSE OF REQUESTING THE DRAFTING, AND THE INTRODUCTION, CONSIDERATION AND PASSAGE, OF A BILL ENTITLED "AN ACT TO AMEND SECTION 29-1-1, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT EXPRESS APPROVAL OF THE LEGISLATURE IS REQUIRED BEFORE THE LEASE, SALE OR OTHER CONVEYANCE BY A STATE PORT AUTHORITY TO A PUBLIC ENTITY OF SPECIFICALLY DESCRIBED REAL PROPERTY ASSOCIATED WITH THE STATE PORT OR HARBOR OPERATED BY THE AUTHORITY; TO AMEND SECTION 29-1-75, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT CERTAIN NONRESIDENT ALIENS AND LEGAL ENTITIES CONTROLLED BY NONRESIDENT ALIENS MAY NOT ACQUIRE OR HOLD ANY REAL PROPERTY OR ANY FACILITY, STRUCTURE, OR OTHER IMPROVEMENT ASSOCIATED WITH A STATE PORT OR HARBOR; TO CREATE AN EXCEPTION FOR CERTAIN NONRESIDENT ALIENS OR LEGAL ENTITIES CONTROLLED BY NONRESIDENT ALIENS WHO OWN PROPERTY THAT IS A PART OF OR ASSOCIATED WITH A STATE PORT OR HARBOR ON DECEMBER 31, 2005; TO AMEND SECTION 59-5-11, MISSISSIPPI CODE OF 1972, TO CLARIFY THAT EXPRESS APPROVAL OF THE LEGISLATURE IS REQUIRED BEFORE THE LEASE, SALE OR OTHER CONVEYANCE BY A STATE PORT AUTHORITY TO A PUBLIC ENTITY OF SPECIFICALLY DESCRIBED REAL PROPERTY ASSOCIATED WITH A STATE PORT OR HARBOR THAT IS OPERATED BY THE AUTHORITY; TO AMEND SECTIONS 59-5-1, 59-5-21, 59-5-23, 59-5-35, 59-5-37 AND 59-5-39, MISSISSIPPI CODE OF 1972, IN CONFORMITY THERETO AND TO CLARIFY THE POWERS OF THE STATE PORT AUTHORITY; TO PROHIBIT A MUNICIPALITY, COUNTY OR OTHER POLITICAL SUBDIVISION FROM IMPOSING CERTAIN IMPACT FEES ON PROPERTY OWNED BY THE STATE THAT IS ASSOCIATED WITH A STATE PORT OR HARBOR OPERATED BY A STATE PORT AUTHORITY, WITHOUT PRIOR EXPRESS APPROVAL OF THE LEGISLATURE; TO AMEND SECTIONS 19-3-40 AND 21-17-5, MISSISSIPPI CODE OF 1972, IN CONFORMITY THERETO; AND FOR RELATED PURPOSES."

     BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF MISSISSIPPI, THE SENATE CONCURRING THEREIN, That the Joint Rules of the House and the Senate, including all the deadlines and other provisions imposed by Joint Rule No. 40, are suspended for the purpose of requesting the drafting, and the introduction, consideration and passage, of a bill entitled "AN ACT TO AMEND SECTION 29-1-1, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT EXPRESS APPROVAL OF THE LEGISLATURE IS REQUIRED BEFORE THE LEASE, SALE OR OTHER CONVEYANCE BY A STATE PORT AUTHORITY TO A PUBLIC ENTITY OF SPECIFICALLY DESCRIBED REAL PROPERTY ASSOCIATED WITH THE STATE PORT OR HARBOR OPERATED BY THE AUTHORITY; TO AMEND SECTION 29-1-75, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT CERTAIN NONRESIDENT ALIENS AND LEGAL ENTITIES CONTROLLED BY NONRESIDENT ALIENS MAY NOT ACQUIRE OR HOLD ANY REAL PROPERTY OR ANY FACILITY, STRUCTURE, OR OTHER IMPROVEMENT ASSOCIATED WITH A STATE PORT OR HARBOR; TO CREATE AN EXCEPTION FOR CERTAIN NONRESIDENT ALIENS OR LEGAL ENTITIES CONTROLLED BY NONRESIDENT ALIENS WHO OWN PROPERTY THAT IS A PART OF OR ASSOCIATED WITH A STATE PORT OR HARBOR ON DECEMBER 31, 2005; TO AMEND SECTION 59-5-11, MISSISSIPPI CODE OF 1972, TO CLARIFY THAT EXPRESS APPROVAL OF THE LEGISLATURE IS REQUIRED BEFORE THE LEASE, SALE OR OTHER CONVEYANCE BY A STATE PORT AUTHORITY TO A PUBLIC ENTITY OF SPECIFICALLY DESCRIBED REAL PROPERTY ASSOCIATED WITH A STATE PORT OR HARBOR THAT IS OPERATED BY THE AUTHORITY; TO AMEND SECTIONS 59-5-1, 59-5-21, 59-5-23, 59-5-35, 59-5-37 AND 59-5-39, MISSISSIPPI CODE OF 1972, IN CONFORMITY THERETO AND TO CLARIFY THE POWERS OF THE STATE PORT AUTHORITY; TO PROHIBIT A MUNICIPALITY, COUNTY OR OTHER POLITICAL SUBDIVISION FROM IMPOSING CERTAIN IMPACT FEES ON PROPERTY OWNED BY THE STATE THAT IS ASSOCIATED WITH A STATE PORT OR HARBOR OPERATED BY A STATE PORT AUTHORITY, WITHOUT PRIOR EXPRESS APPROVAL OF THE LEGISLATURE; TO AMEND SECTIONS 19-3-40 AND 21-17-5, MISSISSIPPI CODE OF 1972, IN CONFORMITY THERETO; AND FOR RELATED PURPOSES."
