AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF MADISON COUNTY TO CONTRACT FOR SERVICES ASSOCIATED WITH THE PREPARATION OF THE COUNTY'S COMPREHENSIVE PLAN FOR DEVELOPMENT; TO PROVIDE THAT ANY SERVICES SO PROVIDED UNDER CONTRACT SHALL BE CONSIDERED SUPPLEMENTARY TO ANY SIMILAR SERVICES PROVIDED BY A LOCAL PLANNING COMMISSION; TO AUTHORIZE THE BOARD TO CONTRACT FOR SUCH SUPPLEMENTARY SERVICES WITH ANY PERSON WHO IS A MEMBER OF AN EXISTING PLANNING COMMISSION AND PAY THE PERSON A FEE FOR SUCH SERVICES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Board of Supervisors of Madison County may contract for any services associated with the preparation, adoption, amendment, extension and carrying out of a comprehensive plan for the purpose of bringing about coordinated development in accordance with present and future needs of the county, as described in Section 17-1-11, Mississippi Code of 1972.  The board is authorized to include, as a part of the execution of such a contract, any aspects of the preparation of the following:  (a) a comprehensive plan of physical development of the municipality or county; (b) a proposed zoning ordinance and map; (c) regulations governing subdivisions of land; (d) building or set back lines on streets, roads and highways; and (e) recommendations to the board with regard to the enforcement of and amendments to the comprehensive plan, zoning ordinance, subdivision regulations and capital improvements program. 

     (2)  If the board has created, independently or jointly, a local planning commission to prepare and propose a comprehensive plan, the services contracted for under the authority of subsection (1) of this section shall be considered supplementary to services provided by the commission to the board.  The board may contract for such supplementary services with any person who is a member of an existing planning commission created under Section 17-1-11, Mississippi Code of 1972, and it may pay the person a contractual fee in addition to any amounts which he or she may otherwise be authorized to receive under Section 17-1-11, Mississippi Code of 1972.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
