House Bill 1540

AN ACT MAKING AN APPROPRIATION FOR THE PURPOSE OF PAYING THE COSTS OF THE CIRCUIT COURT AND CHANCERY COURT DEPARTMENTS, OFFICES OF THE DISTRICT ATTORNEYS AND CRIMINAL INDIGENT DEFENSE IN HANCOCK, HARRISON AND JACKSON COUNTIES THAT ARE ORDINARILY FUNDED BY THE COUNTIES, BUT WHICH THE COUNTIES WILL NOT BE ABLE TO FUND ADEQUATELY BECAUSE OF LOSS OF REVENUES AS A RESULT OF HURRICANE KATRINA, FOR THE PERIOD BEGINNING UPON THE PASSAGE OF THIS ACT AND ENDING JUNE 30, 2007.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1.  The following sum, or so much of it as may be necessary, is appropriated out of any money in the State General Fund not otherwise appropriated, for the purpose specified in Section 2, for the period beginning upon the passage of this act and ending June 30, 2007$4,530,668.47.

     SECTION 2.  The money appropriated by this act is for the purpose of paying the costs of the circuit court and chancery court departments, offices of the district attorneys and criminal indigent defense in Hancock, Harrison and Jackson Counties that are ordinarily funded by the counties, but which the counties will not be able to fund adequately because of loss of revenues as a result of Hurricane Katrina.  The money appropriated by this act shall be allocated as follows:

     SECTION 3.  The money appropriated by this act shall be paid by the State Treasurer out of any money in the State General Fund not otherwise appropriated, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person, officer or officers in the manner provided by law.

     SECTION 4.  This act shall take effect and be in force from and after its passage.
