House Bill 1403

AN ACT TO REQUIRE RETAIL ESTABLISHMENTS TO KEEP CIGARETTE ROLLING PAPERS BEHIND A COUNTER OR IN A LOCKED DISPLAY CASE; TO PROVIDE PENALTIES FOR VIOLATIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  All cigarette rolling papers shall be stored by retail establishments by:

          (a)  Placing the cigarette rolling papers behind a counter where the public is not permitted; or

          (b)  Placing the cigarette rolling papers in a locked display case so that a customer wanting access to the cigarette rolling papers must ask a store employee for assistance.

     (2)  Any violation of this section is a misdemeanor subject to a fine of not more than Two Hundred Fifty Dollars ($250.00).

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2006.
