House Bill 1079

AN ACT TO CREATE THE CRIMINAL OFFENSE OF TRANSPORTING ILLEGAL ALIENS INTO THE STATE; TO PROVIDE PENALTIES FOR VIOLATIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  It shall be unlawful to transport illegal aliens into the state for any purpose.  Any person who violates the provisions of this section shall, upon conviction, be punished as follows:

          (a)  For a first offense the offense shall be a misdemeanor and the punishment shall be a fine of Five Thousand Dollars ($5,000.00) and/or imprisonment for six (6) months for each illegal alien transported;

          (b)  For a second offense committed within five (5) years, the offense shall be a felony and the punishment shall be a fine of Ten Thousand Dollars ($10,000.00) and/or imprisonment for three (3) years for each illegal alien transported; and

          (c)  For a third offense committed within five (5) years, the offense shall be a felony and the punishment shall be a fine of Twenty-five Thousand Dollars ($25,000.00) and/or imprisonment for ten (10) years for each illegal alien transported.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2006.
