House Bill 1036

AN ACT TO AMEND SECTION 21-19-3, MISSISSIPPI CODE OF 1972, TO AUTHORIZE MUNICIPALITIES TO ASSESS MOSQUITO CONTROL FEES ON WATER/SEWER BILLS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 21-19-3, Mississippi Code of 1972, is amended as follows:

     21-19-3.  (1)  The governing authorities of municipalities shall have the power to make regulations to prevent the introduction and spread of contagious or infectious diseases; to make quarantine laws for that purpose, and to enforce the same within five (5) miles of the corporate limits; and to establish pesthouses outside the corporate limits, and to provide for the support and government of the same.

     (2)  The governing authorities of any municipality, in their discretion, may fix and collect fees for mosquito control, and such fees may be assessed to the water/sewer bills of the consumers of the municipality and may be collected from such water/sewer bills.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
