House Bill 989

AN ACT TO PROVIDE THAT THE STATE'S OFFICIAL POSITION IS TO SUSTAIN LIFE WHEN CONFLICTS ARISE REGARDING REMOVAL OF LIFE SUPPORT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  When a person is kept alive through a life support system and there is a division, conflicting testimony or preferences between family members about keeping or removing the life support system and the person on the life support system has no living will, the official position of the state is that the person's life should be sustained and therefore the life support system shall not be removed.  All courts in the state shall follow this position in any case where the conditions described in this section are present.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
