AN ACT TO REQUIRE THE DIVISION OF MEDICAID TO ALLOW CERTAIN FAITH-BASED ASSISTED LIVING FACILITIES TO PARTICIPATE IN THE MEDICAID ASSISTED LIVING WAIVER PROGRAM AND PROVIDE REIMBURSEMENT FOR ELIGIBLE RESIDENTS OF SUCH FACILITY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The Division of Medicaid shall allow any faith-based nonprofit corporation incorporated in the State of Mississippi that constructs an assisted living facility, not exceeding twenty (20) beds, near the intersection of Highway 43 and Goodloe Road in Madison County as a demonstration project that will provide personal care, vocational, recreational, mental and spiritual services to adults with all levels of mental retardation throughout their lives, to participate in the Medicaid assisted living waiver program, and the division shall provide reimbursement for all Medicaid eligible residents of such facility.  The Division of Medicaid and the nonprofit corporation that operates the assisted living facility shall report annually on the status of the demonstration project to the House Public Health and Human Services Committee, the House Medicaid Committee and the Senate Public Health and Welfare Committee, not later than December 31 of the year.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2006.
