AN ACT TO AMEND SECTION 31-9-13, MISSISSIPPI CODE OF 1972, TO EXTEND THE DATE OF THE REPEALER ON THE SECTION THAT ESTABLISHES A REVOLVING FUND FOR THE OFFICE OF GENERAL SERVICES TO BE USED FOR THE OPERATING EXPENSES OF THE OFFICE REGARDING SURPLUS PROPERTY TRANSACTIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 31-9-13, Mississippi Code of 1972, is amended as follows:

     31-9-13.  In lieu of regular appropriations, the Office of General Services may assess against each institution, agency or individual acquiring surplus property from and through the Office of General Services a fee or commission on each item in sufficient amount to establish and maintain a revolving fund, to be used to operate and support the Office of General Services.  The Office of General Services shall follow the procedure outlined by the United States Department of Health and Human Services in establishing  the fund, and the fund shall never exceed more than One Million Dollars ($1,000,000.00) above and beyond four (4) months of operating expenses of the Office of General Services.

     With this revolving fund so acquired, the Office of General Services shall meet all items of expense incurred in acquiring, transporting, warehousing and distributing property to eligible applicants and also all items of expense incident to the operation of the offices of the Office of General Services, including salaries, office supplies and necessary general expenses, and all other items as are covered by legislative appropriation for those purposes.

     The Office of General Services may escalate, budget and expend funds from the revolving fund in an amount not to exceed Two Hundred Fifty Thousand Dollars ($250,000.00) in any one fiscal year to carry out the provisions of this section.

     This section shall stand repealed on July 1, 2008.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2006.
