AN ACT TO AUTHORIZE THE OPERATION OF ALL-TERRAIN VEHICLES ON COUNTY TWO-LANE ROADS FOR WORK-RELATED PURPOSES ONLY; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) For the purposes of this act, the term "all-terrain vehicle" means any motorized vehicle manufactured and designed exclusively for off-road use that is fifty (50) inches or less in width, has an unladen dry weight of six hundred (600) pounds or less, travels on three (3), four (4) or more low pressure tires, has a seat designed to be straddled by the operator and uses handlebars for steering control.
(2) An all-terrain vehicle, as defined in subsection (1) of this section, may be operated on any county two-lane road that is under the jurisdiction of the board of supervisors when being used for work-related purposes only. All-terrain vehicles that are operated on a county two-lane road shall meet the following additional requirements:
(a) The all-terrain vehicle shall display a triangular slow-moving-vehicle emblem as required under Section 63-7-91;
(b) The all-terrain vehicle shall only be operated on roads between sunrise and sunset; and
(c) The all-terrain vehicle shall be operated with its lights on at all times.
(3) A person operating an all-terrain vehicle as authorized under this section shall have all the rights and duties applicable to drivers or riders of vehicles under Section 63-3-207.
SECTION 2. This act shall take effect and be in force from and after July 1, 2006.
