AN ACT TO PROHIBIT NURSING HOMES THAT HAVE A CERTAIN PERCENTAGE OF MEDICAID PATIENTS FROM CHARGING THE PRIVATE PAY PATIENTS MORE THAN THE AMOUNT THAT THE DIVISION OF MEDICAID PAYS THE NURSING HOME FOR PROVIDING THE SAME SERVICE TO THE MEDICAID PATIENTS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The following shall be codified as Section 43-11-20, Mississippi Code of 1972:

     43-11-20.  If two-thirds (2/3) or more of the patients in a nursing facility during any month are eligible for and receiving Medicaid, the nursing facility shall not charge the private pay patients in the facility during that month for any service provided to them, a greater amount than the amount that the Division of Medicaid pays the nursing facility for providing the same service to the Medicaid patients in the facility during that month.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2006.
