AMENDMENT NO 1 PROPOSED TO

     AMEND by striking Section 5 in its entirety and renumber subsequent sections, and insert in lieu thereof the following:

     SECTION 5.  Section 97-17-77, Mississippi Code of 1972, is amended as follows:

     97-17-77.  If any person shall move, or cause to be removed, or aid or assist in removing from the county in which it may be or to any place beyond the jurisdiction of this state, any personal property which shall at the time of such removal be under written pledge, or mortgage, or deed of trust, or conditional sales contract, or lien by judgment, or any other lien in this state, with intent to defraud the pledgee, mortgagee, trustee, cestui que trust, conditional vendor, or creditor, or who shall sell or dispose of the property or any part thereof without the consent of the holder of the lien, he shall be guilty of a misdemeanor and, upon conviction, shall be fined not more than One Thousand Dollars ($1,000.00) or imprisoned in the county jail not more than twelve (12) months, or both.  The removal with intent to defraud of such property valued at Four Hundred Dollars ($400.00) or more shall be a felony punishable upon conviction by a fine of not less than Five Hundred Dollars ($500.00) nor more than Five Thousand Dollars ($5,000.00), or by imprisonment in the penitentiary not less than one (1) nor more than three (3) years, or by both.

     SECTION 6.  Section 97-17-75, Mississippi Code of 1972, which provides a penalty for removing personal property subject to a lien from the county, or selling it, is repealed.

     FURTHER amend the title on line 10 by changing "SECTION97-17-75" to "SECTION 97-17-77" and on line 11 by inserting after the semicolon the following:

TO REPEAL SECTION 97-17-75, MISSISSIPPI CODE OF 1972, WHICH PROVIDES A PENALTY FOR REMOVING PERSONAL PROPERTY SUBJECT TO A LIEN FROM THE COUNTY, OR SELLING IT;
