REPORT OF CONFERENCE COMMITTEE

 

MADAM PRESIDENT AND MR. SPEAKER:

 

   We, the undersigned conferees, have had under consideration the amendments to the following entitled BILL:

 

S. B. No. 2608:  Public property; authorize Dept. of Mental Health to sell certain property in Meridian, MS.

 

  We, therefore, respectfully submit the following report and recommendation:

 

  1.  That the House recede from its Amendment No. 1.

 

  2.  That the Senate and House adopt the following amendment:

 

     Amend by striking all after the enacting clause and inserting in lieu thereof the following:

 


     SECTION 1.  (1)  The Department of Finance and Administration, acting on behalf of the Mississippi Department of Mental Health, and upon meeting the requirements of Section 29-1-1, may sell and convey all or part of certain state-owned real property located in the City of Meridian, Lauderdale County, commonly known as the Matty Hersee Hospital, more particularly described as follows:

     PARCEL ONE

Commencing at the Southwest corner of the Southeast 1/4 of the Northeast 1/4 of Section 14,Township 6 North, Range 15 East, Meridian, Lauderdale County, Mississippi; thence from said point run East 34.0 feet; thence run North 30.0 feet to the point of intersection of the Easternmost right-of-way line of 53rd Avenue and the Northernmost right-of-way line of Valley Street; thence from said point run North 89 degrees 40 minutes 30 seconds East a distance of 519.74 feet more or less along the North right-of-way line of Valley Street to the POINT OF BEGINNING of the herein described parcel, said POINT OF BEGINNING also being the Southeast corner of a parcel of property leased to the Lauderdale County Board of Supervisors; thence from said POINT OF BEGINNING run North 89 degrees 40 feet 30 seconds East a distance of 370.22 feet more or less along the Northernmost right-of-way line of Valley Street to its intersection with the Westernmost right-of-way line of US Highway 11; thence along said right-of-way line, North 10 degrees 44 minutes 05 seconds East a distance of 117.47 feet more or less to a point; thence along a curve to the left having a chord bearing and distance of North 31 degrees 00 minutes 42 seconds West 431.43 feet, said curve having a radius of 323.03 feet and an arc length of 472.42 feet to a point on the South right-of-way line of Mississippi Highway 19;  thence along said South right-of-way line as follows:  North 73 degrees 03 minutes 29 seconds West a distance of 315.62 feet; thence South 17 degrees 22 minutes 07 seconds West 25.0 feet; thence North 72 degrees 54 minutes 33 seconds West 150.0 feet; thence North 17 degrees 05 minutes 07 seconds East 15.0 feet; thence North 72 degrees 55 minutes 04 seconds West a distance of 48.12 feet to a point being the Northeast corner of the lease parcel of the Mississippi Highway Patrol; thence run South 00 degrees 38 feet 07 seconds East along the East line of the Mississippi Highway Patrol lease parcel a distance of 250.99 feet more or less to the North line of the previously referenced Lauderdale County Mississippi lease; thence along the Northerly and Easterly lines of said lease parcel as follows:  North 84 degrees 16 minutes 11 seconds East a distance of 64.83 feet; thence North 85 degrees 28 minutes 31 seconds East a distance of 155.54 feet; thence run South 04 degrees 34 minutes 59 seconds East a distance of 202.0 feet; thence South 21 degrees 00 minutes 59 seconds East a distance of 67.15 feet; thence South 67 degrees 31 minutes 01 seconds East a distance of 57.12 feet; thence South 05 degrees 18 minutes 04 seconds East a distance of

     109.75 feet to the POINT OF BEGINNING and said parcel     containing 6.0 acres more or less and being located

     in part of the Southeast 1/4 of the Northeast 1/4 of

     Section 14, Township 6 North, Range 15 East, Lauderdale   County, Mississippi; LESS AND EXCEPT THEREFROM the 1.5

     acre tract situated in part of the Southeast 1/4 of the   Northeast 1/4 of Section 14, Township 6 North, Range 15

     East, Meridian, Lauderdale County, Mississippi, and

     described in Section 2 of this act as PARCEL TWO.

     (2)  Meridian Community College shall have the right of first refusal to purchase or lease-purchase the real property described as Parcel One in subsection (1) of this section.

     (3)  The real property described in subsection (1) of this section shall be sold for not less than the current fair market value as determined by the averaging of at least two (2) appraisals by qualified appraisers who shall be selected by the Department of Finance and Administration and shall be certified and licensed by the Mississippi Real Estate Appraiser Licensing and Certification Board. 

     (4)  Any funds received by the State of Mississippi for the sale and conveyance of the real property described in subsection (1) of this section shall be deposited into the East Mississippi State Hospital Fund, Department of Mental Health.

     (5)  The State of Mississippi shall retain all mineral rights to the real property sold and conveyed pursuant to this section.

     SECTION 2.  (1)  The Department of Finance and Administration, acting on behalf of the Mississippi Department of Mental Health, may sell to Meridian Community College, on such terms and conditions as agreed to by such parties, certain state-owned real property located in the City of Meridian, Lauderdale County, more particularly described as follows:

PARCEL TWO

     A certain 1.50 acre tract situated in part of the

     Southeast 1/4 of the Northeast 1/4 of Section 14,

     Township 6 North, Range 15 East, Meridian,

     Lauderdale County, Mississippi, and being more

     particularly described as follows:

     Commencing at a nail found marking the Southwest

     corner of the Southeast 1/4 of the Northeast 1/4 of

     Section 14, Township 6 North, Range 15 East, Meridian,    Lauderdale County, Mississippi; thence East 34.00 feet; thence North 30.00 feet to an iron pin marking the intersection of the North right-of-way line of Valley

     Street with the Easterly right-of-way line of 53rd

     Avenue; thence along said Easterly line, North 00

     degrees 38 minutes 07 seconds West 692.38 feet to an

     iron pin found on the South right-of-way line of

     Mississippi Highway No. 19; thence along said South

     line, South 72 degrees 55 minutes 04 seconds East

     211.22 feet to an iron pin found marking the

     Northeast corner of that certain tract leased to

     the Mississippi Highway Patrol, said point being

     the Point of Beginning of the herein described

     tract; thence along said South line as follows: 

     South 72 degrees 55 minutes 04 seconds East 48.12

     feet, South 17 degrees 05 minutes 07 seconds West

     15.00 feet, South 72 degrees 54 minutes 53 seconds

     East 150.00 feet, North 17 degrees 22 minutes 07

     feet to the Northeast corner of that certain tract

     leased for the Lauderdale County Multipurpose Health

     Center; thence along the North line of said lease tract, South 85 degrees 28 minutes 31 seconds West 155.54 feet

     to an iron pin found; thence along said North lease

     line, South 84 degrees 16 minutes 11 seconds West 64.83

     feet to a point on the East line the aforesaid tract

     leased to the Mississippi Highway Patrol; thence along

     said East line, North 00 degrees 38 minutes 07 seconds

     West 250.99 feet to the Point of Beginning, containing

     1.50 acres, more or less.

     (2)  The real property described in subsection (1) of this section shall be sold for not less than the current fair market value as determined by the averaging of at least two (2) appraisals by qualified appraisers who shall be selected by the Department of Finance and Administration and shall be certified and licensed by the Mississippi Real Estate Appraiser Licensing and Certification Board. 

     (3)  Any funds received by the State of Mississippi for the sale and conveyance of the real property described in subsection (1) of this section shall be deposited into the East Mississippi State Hospital Fund, Department of Mental Health.

     (4)  The State of Mississippi shall retain all mineral rights to the real property sold and conveyed pursuant to this section.

     (5)  The provisions of this section shall stand repealed on July 1, 2006.

     SECTION 3.  (1)  The Mississippi Department of Transportation may transfer and convey to the City of Brookhaven, Mississippi, all of the right, title and interest in certain real property located within the County of Lincoln, described more specifically as follows:

     2.63 acres, more or less, situated in Lot 7 of the Price Estate, City of Brookhaven, said lands are situated in the SW 1/4 of the SE 1/4 of Section 12, Township 7 North, Range 7 East, Lincoln County, Mississippi, and described in particular as follows:  Commencing at a Nail in the center of Hartman Street marking the NE Corner of the SW 1/4 of the SE 1/4 of Section 12 run N 89°16'00"W 30.00 ft. to a Fence Corner on the West side of said Hartman Street and the Point of Beginning.  Thence S 00°16'45"E 125.22 ft. along said Street to a 1/2 Inch Iron Pin on the North Right-of-Way of the Mississippi Central Railroad, thence away from said Street and along said Right-of-Way S 77°53'15"W 618.94 ft. to a concrete Right-of-Way Marker, thence away from said Railroad Right-of-Way N 00°41'00"W 251.91 ft. to a concrete Right-of-Way Marker, thence N 89°41'45"E 607.56 ft. to the Point of Beginning.

     (2)  The conveyance authorized in this section may be subject to additional terms and conditions accepted and agreed upon by the Mississippi Department of Transportation and the City of Brookhaven, Mississippi.

     SECTION 4.  (1)  The Mississippi Department of Transportation may transfer and convey to the City of Woodville, Mississippi, all of the right, title and interest in certain real property located within the County of Wilkinson, described more specifically as follows:

     From the Southwest Corner of Section 27, Township 2 North, Range 2 West, run thence North 0° 58' 15" East, a distance of 390.0 feet; thence South 89° 01' 45" East, a distance of 1100.0 feet; thence South 77° 01' 45" East, a distance of 359.0 feet to the centerline of U.S. Highway No. 61 and 65 at Station 436 + 74.27 (F-62-(2)); thence Northerly along the centerline of said highway, a distance of 1916.07 feet to Station 455 + 90.34 on the centerline of said highways (F-41-(4)); thence North 13° 29' 45" West, a distance of 501.7 feet; thence South 70° 05' 45" East, a distance of 670.3 feet to the point of beginning of the parcel of land herein conveyed; thence North 3° 55' East along a line that is parallel with and 50 feet from the West boundary of that certain parcel of land conveyed to the Town of Woodville, Mississippi, by G.E. Miller and wife, Mary R. Miller, by deed recorded in Wilkinson County Deed Record Book 4-L, page 45, a distance of 323.0 feet; thence East, a distance of 150.1 feet; thence South 3° 55' West, a distance of 345.9 feet to a point on the Northerly boundary of Sweeny Town Lane; thence North 86° 40' West, a distance of 76.6 feet; thence North 75° 41' West, a distance of 74.6 feet to the point of beginning, containing 1.16 acres, more or less, and being situated in the East 1/2 of the West 1/2 of Section 27, Township 2 North, Range 2 West, Town of Woodville, Wilkinson County, Mississippi.

     (2)  The conveyance authorized in this section may be subject to additional terms and conditions accepted and agreed upon by the Mississippi Department of Transportation and the City of Woodville, Mississippi.

     SECTION 5.  (1)  The Mississippi Department of Transportation may transfer and convey to the County of Lawrence, Mississippi, all of the right, title and interest in certain real property located within the County of Lawrence, described more specifically as follows:

     2.89 Acres, more or less, situated in the East 1/2 of the NE 1/4 of Section 32, Township 7 North, Range 11 East, Lawrence County, Mississippi, and described in particular as follows:  Commencing at a Cotton Picker Spindle marking the NE Corner of said Section 32 run WEST 14.43 ft., run SOUTH 589.41 ft. to a 1/2 Inch Iron Pin on the East R/W of old Highway 27 50 ft. rt. of Station 1745+80 and the point of beginning.  Thence S 00°25'00"E 1375.55 ft. to a R/W Marker, thence S 56°53'30"W 250.03 ft. to a R/W Marker, thence N 10°47'30"E 184.12 ft. to a 1/2 Inch Iron Pin, thence N 79°10'15"W 10.00 ft. to a 1/2 Inch Iron Pin, thence along a R/W Curve to the left with a Delta Angle of 6°40'43", a Radius of 11509.16 ft., a Length of 1341.55 ft., and a Chord of N 07°29'20"E 1340.79 ft. to the Point of Beginning.

     (2)  The conveyance authorized in this section may be subject to additional terms and conditions accepted and agreed upon by the Mississippi Department of Transportation and the Board of Supervisors of Lawrence County, Mississippi.

     SECTION 6.  Section 37-33-157, Mississippi Code of 1972, is amended as follows:

     37-33-157.  The Department of Rehabilitation Services shall provide the rehabilitation services authorized by law and by the rules, regulations and policies of the board to every individual determined to be eligible therefor, and in carrying out the purposes of this chapter the department is authorized, when consistent with the rules, regulations and policies of the State Board of Rehabilitation Services:

          (a)  To expend funds received either by appropriation or directly from federal or private sources;

          (b)  To cooperate with other departments, agencies and institutions, both public and private, in providing the services authorized by this chapter to disabled individuals, in studying the problems involved therein, and in establishing, developing and providing in conformity with the purposes of this chapter, such programs, facilities and services as may be necessary or desirable;

          (c)  To enter into reciprocal agreements with other states to provide for the services authorized by this chapter to residents of the states concerned;

          (d)  To conduct research and compile statistics relating to the provision of services to or the need of services by disabled individuals;

          (e)  To enter into contractual arrangements with the federal government and with other authorized public agencies or persons for performance of services related to rehabilitation;

          (f)  To contract with schools, hospitals and other agencies, and with doctors, optometrists, nurses, technicians and  other persons, for training, physical restoration, transportation and other rehabilitation services;

          (g)  To take such action as may be necessary to enable the department to apply for, accept and receive for the state and its residents the full benefits available under the federal Vocational Rehabilitation Act, and any amendments thereto, and under any other federal legislation or program having as its purpose the providing of, improvement or extension of, vocational rehabilitation services;

          (h)  To establish an Office on the Deaf and Hard of Hearing to provide services and activities authorized under Section 37-33-171;

          (i)  To own in the name of the State of Mississippi certain real property described in Section 6 of Senate Bill No. 2608, 2005 Regular Session, and to construct, renovate or repair under the supervision of the Department of Finance and Administration any buildings on such property.

     SECTION 7.  (1)  The Department of Finance and Administration may assign to the Department of Rehabilitation Services certain state-owned real property located in the City of Madison, Madison County, Mississippi, being more particularly described as follows:

     Commencing at the Southwest Corner of Section 4, Township 7 North, Range 2 East, in the Town of Madison, Madison County, Mississippi, and thence run S 89°34'00"E for a distance of 139.20 feet to the West Right-of-Way (100.00') line of U.S. Highway 51 as it is now laid out and exists; thence run N23°20'00"E along said West Right-of-Way for a distance of 2,040.10 feet to a point, said point being the point of beginning of the herein described survey; thence continue N23°20'00"E along said West Right-of-Way for a distance of 974.52 feet to an iron pin on the North line of Southwest 1/4, Section 4, T7N, R2E, Madison County, Mississippi; thence run N89°25'54"W along said North line of the Southwest 1/4 for a distance of 911.22 feet to an iron pin; thence run N27°40'33"E for a distance of 136.12 feet to an iron pin; thence run N73°04'35"W for a distance of 244.23 feet to an iron pin on the East Right-of-Way of the Illinois Central Gulf Railroad as it is now laid out and exists; thence run S22°56'41"W along said East right-of-way for a distance of 250.28 feet to an iron pin; thence run S17°20'50"W for 291.36 feet along a line that is 15 feet Easterly of and parallel to the centerline of a spur track; thence run 217.18 feet along the arc of a 716.44 foot radius curve to the left along a line which is 15 feet Easterly of and parallel to the centerline of a spur track, said arc having a 216.35 foot chord which bears South 08°39'47"W; thence run 187.55 feet along the arc of a 5,748.63 foot radius curve to the left along a line which is 15 feet Easterly of and parallel to the centerline of a spur track, said arc having 187.54 foot chord which bears S00°57'22"E; thence S66°40'00"E for a distance of 45.01 feet to an iron pin; thence turn N82°45'29"E for a distance of 618.60 feet to an iron pin; thence S39°14'41"E for a distance of 170.0 feet to an iron pin; thence run S57°32'12"E for a distance of 142.00 feet to an iron pin; thence run S35°42'29"E for a distance of 46.54 feet to an iron pin, said iron pin being the point of beginning containing 19.4 acres more or less.  Parcel is subject to any changes in the right-of-way of U.S. Hwy. No. 51.

     (2)  The Department of Finance and Administration shall have the authority to transfer and expend any funds remaining in Mississippi Treasurer's Fund Numbers 3907 and 3998 for a project to repair, and to construct an addition to, the Department of Rehabilitation Services Building located on the property described in subsection (1) of this section.

     SECTION 8.  (1)  The Department of Finance and Administration may assign to the Department of Public Safety certain state-owned real property located in the City of West Point, Clay County, Mississippi, more particularly described as follows:

     A parcel of land located in the City of West Point,

     Clay County, MS; being described as Block 70, part

     of Block 6, a part of the undeveloped Cooper Street,

     and a part of Block 46, all per the C.L. Wood Map of

     said City; being further described as Block 120 and

     part of Lot 3 in Block 122 of the 1979 A.L. Goodman

     Map of the City of West Point, MS; being more

     particularly described as follows:

     Commencing at an iron pin located at the southeast

     corner of above said Block 120, said pin lying at

     the intersection of the north right-of-way (25

     feet from centerline) of Main Street with the west

     right-of-way line (30 feet from centerline) of

     College Street, and said iron pin being the Point

     of Beginning for this description; Run thence North

     00 degrees 09 minutes 40 seconds West along the

     west right-of-way line of College Street 300.00

     feet to an iron pin, thence run South 89 degrees

     52 minutes 20 seconds West 380.65 feet, thence

     run South 46 degrees 19 minutes 40 seconds East

     433.41 feet to an iron pin lying on the north

     right-of-way of Main Street, thence run North 89

     degrees 52 minutes 20 seconds East 68.02 feet to

     the Point of Beginning; containing 1.54 acres,

     more or less.

     LESS AND EXCEPT and reserved to the Grantor herein

     is a 10 foot wide public utility easement along

     the entire South side of the above described

     parcel, lying adjacent to the right-of-way for

     Main Street.

     (2)  A new building and related facilities necessary to house the Bureau of Narcotics in the Starkville District shall be constructed on the real property described in subsection (1) of this section using the proceeds of bonds as provided in Senate Bill No. 2010, 2004 Third Extraordinary Session.

     SECTION 9.  This act shall take effect and be in force from and after its passage.


     Further, amend by striking the title in its entirety and inserting in lieu thereof the following:
