Senate Bill 3022

AN ACT TO AUTHORIZE AN INCOME TAX CREDIT FOR CERTAIN EMPLOYERS WHO PROVIDE A BASIC HEALTH BENEFITS PLAN FOR THEIR EMPLOYEES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  A taxpayer who employs less than twenty-five (25) persons and provides a basic health benefits plan for all his employees, shall be eligible for a credit against the taxes imposed by this chapter in the amount of Four Hundred Dollars ($400.00).  To qualify for the credit authorized by this section, the basic health benefits plan must be equivalent to the health benefit plan provided to state employees.

     (2)  The State Tax Commission shall adopt rules and regulations to implement the provisions of this section.

     SECTION 2.  Section 1 of this act shall be codified in Chapter 7, Title 27, Mississippi Code of 1972.

     SECTION 3.  This act shall take effect and be in force from and after January 1, 2005.
