AN ACT TO AMEND SECTION 69-39-19, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT LIME REGULATIONS ADOPTED BY THE COMMISSIONER OF AGRICULTURE SHALL BE IN ACCORDANCE WITH THE ADMINISTRATIVE PROCEDURES ACT; TO CREATE SECTION 69-39-21, MISSISSIPPI CODE OF 1972, TO PLACE A REPEALER ON "THE MISSISSIPPI AGRICULTURAL LIMING MATERIAL ACT OF 1993"; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 69-39-19, Mississippi Code of 1972, is amended as follows:

     69-39-19.  The commissioner may, with the approval of the Attorney General as provided in Section 69-1-25, * * * promulgate such rules and regulations in accordance with the Mississippi Administrative Procedures Law as may be necessary for the effective enforcement of this chapter.  The regulations * * * shall have the full force and effect of law.

     SECTION 2.  The following section shall be codified as Section 69-39-21, Mississippi Code of 1972:

     69-39-21.  Sections 69-39-1 through 69-39-19 shall be repealed on July 1, 2009.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2005.
