AN ACT TO AMEND SECTION 83-6-29, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT COMMERCIAL AND FINANCIAL INFORMATION OF A PROPRIETARY NATURE OBTAINED BY OR DISCLOSED TO THE COMMISSIONER OF INSURANCE SHALL BE EXEMPTED FROM THE MISSISSIPPI PUBLIC RECORDS ACT OF 1983; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 83-6-29, Mississippi Code of 1972, is amended as follows:

     83-6-29.  Any commercial and financial information of a proprietary nature obtained by or disclosed to the commissioner or any other person in the course of an examination or investigation made pursuant to Section 83-6-27, and any such information reported pursuant to Section 83-6-24 or Sections 83-6-3 through 83-6-19, shall be governed by Section 79-23-1 and shall be exempt from the provisions of the Mississippi Public Records Act of 1983; provided, however, any such information may be shared by the commissioner with the insurance departments of other states * * *Further, notwithstanding the foregoing, the commissioner by rule may designate certain types of information as public information that is not exempt from the Mississippi Public Records Act of 1983.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
