AN ACT TO CREATE THE CRIME OF RECKLESS ENDANGERMENT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  A person is guilty of reckless endangerment if he or she recklessly engages in conduct which places another person in danger of death or serious bodily injury.

     (2)  A person who violates this section shall be guilty of a misdemeanor punishable by imprisonment for not more than one (1) year or a fine of not more than Two Thousand Dollars ($2,000.00), or both.

     (3)  The provisions of this section shall be cumulative to any other provision of law and shall not bar prosecution under any other criminal statute.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2005.
