AN ACT TO AMEND SECTION 63-3-212, MISSISSIPPI CODE OF 1972, TO PROHIBIT THE USE OF ALL BUT HANDS-FREE CELLULAR TELEPHONES WHILE OPERATING A MOTOR VEHICLE; TO PROVIDE A PENALTY FOR VIOLATIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 63-3-212, Mississippi Code of 1972, is amended as follows:

     63-3-212.  (1)  It is unlawful for any person to use a cellular telephone while operating a motor vehicle unless the cellular telephone is a hands-free model of cellular telephone.  Any person who violates the provisions of this section shall be guilty of a misdemeanor and upon conviction shall be fined not more than Five Hundred Dollars ($500.00).

     (2)  No county, municipality or other political subdivision shall enact any ordinance restricting the use of cellular phones in any motor vehicle until such time as the state may authorize a county, municipality or other political subdivision to enact such an ordinance.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2005.
