House Bill 1413

AN ACT TO AUTHORIZE THE DEPARTMENT OF MENTAL HEALTH TO SELL AND CONVEY CERTAIN PROPERTY IN SIMPSON COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Department of Finance and Administration may sell and convey certain real property and any improvements thereon, in Simpson County, Mississippi, the property being more particularly described as follows:

Begin at the SE Corner of the SW 1/4 of SE 1/4 of Section 3, Township 10 North, Range 18 West, and run West 2174 feet; thence run North 1528.8 feet to the North line of the SE 1/4 of SW 1/4; thence run East 1165.8 feet; thence run North 1528.8 feet; thence run West 293.8 feet; thence run North 1537 feet; thence run East 726 feet; thence run North 585 feet; thence run East 652 feet to the center of an old road; thence run South 34 degrees East 279 feet along the center of said old road; thence run South 51 degrees East 161 feet along the center of said old road; thence run South 25 degrees East 216 feet along the center of said old road; thence run South 7 degrees East 340 feet along the center of said old road; thence run South 46 degrees East 30.3 feet along the center of said old road; thence run South 13 degrees East 334 feet along the center of said old road; thence run South 79 degrees East 232 feet along the center of said old road; thence run South 80 degrees East 367 feet along the center of said old road to a point where same intersects the East line of the SE 1/4 of NE 1/4; thence run South 527 feet along said East line of SE 1/4 of NE 1/4 to the SE Corner of same; thence run West 660 feet; thence run South 514 feet; thence run West 660 feet to the East line of the NW 1/4 of SE 1/4; thence run South 2570 feet back to the point of beginning, containing 206.47 acres, more or less, and being in the NE 1/4; the SE 1/4; and also in the SE 1/4 of SW 1/4 of Section 3, Township 10 North, Range 18 West, Simpson County, Mississippi.

     (2)  The sale and conveyance authorized in this section may be made on such terms and conditions established by the Department of Mental Health to be in the best interests of the state.  The real property described in subsection (1) of this section shall be sold for not less than the current fair market value as determined by the averaging of at least two (2) appraisals by professional appraisers who are licensed by the Mississippi Real Estate Appraiser Licensing and Certification Board.

     (3)  Any funds received by the State of Mississippi for the conveyance of the real property described in subsection (1) of this section shall be deposited into the State General Fund.

     (4)  The State of Mississippi shall retain all mineral rights to the real property sold pursuant to this section.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
