AN ACT TO AMEND SECTION 73-21-81, MISSISSIPPI CODE OF 1972, TO REQUIRE THE BOARD OF PHARMACY TO ESTABLISH GUIDELINES FOR THE SAFE STORAGE OF NARCOTICS IN PHARMACIES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 73-21-81, Mississippi Code of 1972, is amended as follows:

     73-21-81.  (1)  The responsibility for the enforcement of the provisions of this chapter shall be vested in the board.  The board shall have all of the duties, powers and authority specifically granted by and necessary to the enforcement of this chapter.  The board may make, adopt, amend and repeal such rules and regulations as may be deemed necessary by the board from time to time for the proper administration and enforcement of this chapter, in accordance with the provisions of the Mississippi Administrative Procedures Law (Section 25-43-1 et seq.).

     (2)  The board shall establish and implement guidelines for the safe storage of narcotics listed in Schedules II, III and IV in pharmacies.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2005.
