AN ACT TO AUTHORIZE THE EXECUTIVE HEAD OF ANY STATE AGENCY  TO DEDUCT ASSOCIATION OR ORGANIZATION DUES FROM THE SALARIES OF STATE EMPLOYEES OF THAT AGENCY UPON WRITTEN AUTHORIZATION FROM THE EMPLOYEE; TO AMEND SECTION 37-9-49, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE DEDUCTION OF DUES FROM THE SALARIES OF CERTIFICATED SCHOOL EMPLOYEES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The executive head of any state agency may deduct or permit to be deducted from the salary of any state employee of that agency, upon written authorization from the employee involved, any dues payable to any organization or association.

     SECTION 2.  Section 37-9-49, Mississippi Code of 1972, is amended as follows:

     37-9-49.  * * * The superintendent of schoolsmay deduct or permit to be deducted from the salary of any superintendent, principal or licensed employee, with written authorization from the employee involved, any dues, fines or penalties payable or alleged to be payable because of the membership of such superintendent, principal or licensed employee in any organization or association.  * * * Dues or premiums in health associations or corporations and tax sheltered annuity deductions authorized by the United States Internal Revenue Code may be deducted upon written authorization from the superintendent, principal or licensed employee involved.  Any superintendent of schools who shall make any such deduction or permit any such deduction to be made, except those herein provided, shall be guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than Twenty-five Dollars ($25.00) for each such deduction.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2005.
