AN ACT TO AMEND SECTION 47-5-110.1, MISSISSIPPI CODE OF 1972, TO INCREASE THE MILEAGE AMOUNT FROM THIRTY-FIVE TO FORTY CENTS PER MILE THAT AN OFFENDER PAYS WHENEVER AN OFFENDER REQUESTS A TRANSFER FROM ONE FACILITY TO ANOTHER; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 47-5-110.1, Mississippi Code of 1972, is amended as follows:

     47-5-110.1.  Whenever an offender in the custody of the Department of Corrections is transferred, upon request, from one (1) facility to another, the offender must pay to the department an amount equal to Forty Cents ($.40) per mile for each mile traveled from the transferor facility to the transferee facility or Twenty-five Dollars ($25.00), whichever is greater, to cover the costs of the transfer.  An offender may not be required to pay for the costs of any transfer that is initiated by the Department of Corrections.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
