AN ACT TO AMEND SECTION 69-39-19, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE COMMISSIONER OF AGRICULTURE TO PROMULGATE RULES AND REGULATIONS IN ACCORDANCE WITH THE ADMINISTRATIVE PROCEDURES LAW FOR THE EFFECTIVE ENFORCEMENT OF THE MISSISSIPPI AGRICULTURAL LIMING MATERIALS ACT OF 1993; TO CREATE NEW CODE SECTION 69-39-21, MISSISSIPPI CODE OF 1972, TO PLACE A REPEALER ON THE MISSISSIPPI AGRICULTURAL LIMING MATERIALS ACT OF 1993; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 69-39-19, Mississippi Code of 1972, is amended as follows:

     69-39-19.  The commissioner is authorized and empowered, with the approval of the Attorney General as provided in Section 69-1-25, to promulgate such rules and regulations, in accordance with Sections 25-43-1 through 25-43-19, known as the "Mississippi Administrative Procedures Law," as may be necessary for the effective enforcement of this chapter.  Regulations adopted as provided herein shall have the full force and effect of law.

     SECTION 2.  The following section shall be codified as Section 69-39-21, Mississippi Code of 1972:

     69-39-21.  Sections 69-39-1, 69-39-3, 69-39-5, 69-39-7, 69-39-9, 69-39-11, 69-39-13, 69-39-15, 69-39-17 and 69-39-19, Mississippi Code of 1972, which provide for The Mississippi Agricultural Liming Materials Act of 1993, shall stand repealed from and after June 30, 2008.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2005.
