AN ACT TO CREATE THE CRIMINAL OFFENSE OF DISCHARGING A FIREARM INTO AN AIRCRAFT; TO PROVIDE PENALTIES FOR VIOLATIONS; TO PROVIDE ENHANCED PENALTIES FOR DISCHARGING A FIREARM INTO A LAW ENFORCEMENT AIRCRAFT; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Any person who shall discharge a firearm into an aircraft shall, upon conviction, be guilty of a felony and shall be punished by imprisonment for twenty (20) years in the Penitentiary and fined Ten Thousand Dollars ($10,000.00). If the aircraft is owned or operated by any law enforcement agency, the penalty for a violation shall be imprisonment for fifty (50) years in the State Penitentiary and fined Twenty Thousand Dollars ($20,000.00).
SECTION 2. This act shall take effect and be in force from and after July 1, 2005.
