AN ACT TO REENACT AND AMEND SECTION 47-5-572, MISSISSIPPI CODE OF 1972, WHICH PROHIBITS PRIVATELY OPERATED CORRECTIONAL FACILITIES FROM IMPORTING CERTAIN GOODS MANUFACTURED USING INMATE LABOR FROM ANOTHER STATE INTO THE STATE OF MISSISSIPPI TO BE USED BY INMATES HOUSED IN INSTATE FACILITIES; TO EXTEND THE DATE OF REPEAL ON THIS SECTION FROM JULY 1, 2005, TO JULY 1, 2007; TO AMEND SECTION 2, CHAPTER 502, LAWS OF 2004, TO REMOVE THE REPEAL DATE FROM WITHIN SUCH SECTION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 47-5-572, Mississippi Code of 1972, is reenacted and amended as follows:

     47-5-572.  (1)  A privately operated correctional facility shall not procure goods, to be used by inmates housed in Mississippi facilities, that have been manufactured using inmates in a correctional system of another state if Mississippi Prison Industries is presently manufacturing the same goods using Mississippi inmates, unless the cost of the goods and services can be procured at a price that is at least thirty percent (30%) less than the cost of the same goods and services provided by Mississippi Prison Industries Corporation.

     (2)  This section shall stand repealed from and after July 1, 2007.

     SECTION 2.  Section 2, Chapter 502, Laws of 2004, is amended as follows:

     Section 2.  This act shall take effect and be in force from and after July 1, 2004 * * *.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2005.
