AMENDMENT NO 1 PROPOSED TO

Senate Concurrent Resolution No.  554

     AMEND lines 21 and 22 by striking "The person receiving the highest number of popular votes shall be declared elected." and inserting in lieu thereof the following:

The person receiving the highest number of votes and at least forty percent (40%) of the total votes cast in the election for the office shall be declared elected.

     If no person receives the required number of votes to be elected, then a runoff election shall be held between the two (2) persons who received the highest number of votes as provided by law.

FURTHER, amend lines 41 through 44 by striking the sentence in quotation marks and inserting the following:

"This proposed constitutional amendment provides that the Governor shall be elected at the general election and the person receiving the highest number of popular votes and at least forty percent (40%) of the total votes cast for that office shall be declared elected Governor.  If no person receives the vote required to be elected, then a runoff election shall be held between the two (2) persons receiving the highest number of votes."

     FURTHER, amend the title on line 4 after "VOTES" by inserting "AND AT LEAST 40% OF THE TOTAL VOTES CAST"

     FURTHER, amend line 4 after the semicolon by inserting: "TO REQUIRE A RUNOFF ELECTION IF NO PERSON RECEIVES THE REQUIRED VOTES"
