AMENDMENT NO 1 PROPOSED TO

Senate Bill No. 2514

     AMEND by inserting after line 13 the following:

     SECTION *.  (1)  It is unlawful for a person to shine a light exceeding 250,000 candle power from a public road onto the adjoining lands of another during the night from one-half (1/2) hour after sunset to one-half (1/2) hour before sunrise.  This section does not apply to the normal use of headlights of a vehicle traveling on a public road, to law enforcement, emergency or utility personnel in the performance of their duty, to a lessee on lands leased by the lessee or to a person having the permission of the landowner.

     (2)  A first offense under this section shall receive a warning citation which shall be of public record.  Any person convicted of a second or subsequent violation of this section shall be punished by a fine of not less than One Hundred Dollars ($100.00) nor more than Five Hundred Dollars ($500.00) or by imprisonment in the county jail for not less than sixty (60) days nor more than six (6) months, or by both such fine and imprisonment.

     FURTHER amend title in line 6 by inserting after the semicolon thereon the following:

TO PROHIBIT THE SHINING OF A HIGH-INTENSITY LIGHT FROM A PUBLIC ROAD ONTO THE ADJOINING LANDS OF ANOTHER DURING THE NIGHT, TO PROVIDE EXCEPTIONS, AND TO PROVIDE PENALTIES FOR VIOLATIONS;
