COMMITTEE AMENDMENT NO 1 PROPOSED TO

House Bill No. 1407

     Amend by striking all after the enacting clause and inserting in lieu thereof the following:

 


     SECTION 1.  A committee is hereby established to make a report to the Legislature on the establishment of a Clearinghouse for People with Disabilities to promote and facilitate the full participation of, and the creation and assurance of equal opportunities for all people with disabilities.  "People with disabilities" means individuals who have physical, sensory, cognitive or mental characteristics such as those listed under the definition of "handicapped person" in Regulation 28CFR 4.31(b) for the implementation of Section 504 of the Rehabilitation Act of 1973, as amended (Public Law 93-112).  The membership of the committee shall be as follows:  (a) the State Superintendent of Education, or his designee; (b) the Executive Director of the State Department of Health, or his designee; (c) the Executive Director of the Mississippi Department of Human Services, or his designee; (d) the Executive Director of the Division of Medicaid, Office of Governor, or his designee; (e) the Executive Director of the Mississippi Department of Mental Health, or his designee; (f) the Executive Director of the State Department of Rehabilitation Services, or his designee; (g) the Chairmen of the Appropriations and Public Health and Welfare Committees of each house of the Legislature, or their designees; (h) a representative of the Coalition for Citizens with Disabilities appointed by the Governor; (i) a representative of an advocacy group for the disabled appointed by the Lieutenant Governor; and (j) a representative of an advocacy group for the disabled appointed by the Speaker of the House of Representatives.  The committee shall meet upon call of the Governor not later than August 1, 2004, and shall select a chairman who shall organize the committee for business.  Staff and clerical support for the committee shall be provided by the agencies represented on the committee.  The committee shall develop a request with specific recommendations for legislation and shall make its report to the Chairmen of the Committees of Public Health and Welfare of each house on or before December 1, 2004.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2004.


     Further, amend by striking the title in its entirety and inserting in lieu thereof the following:

 


     AN ACT TO ESTABLISH A COMMITTEE TO MAKE A RECOMMENDATION TO THE LEGISLATURE ON THE ESTABLISHMENT OF A MISSISSIPPI CLEARINGHOUSE FOR PEOPLE WITH DISABILITIES; AND FOR RELATED PURPOSES.
