SECTION 1. (1) (a) In consideration for the conveyance of property authorized in subsection (2) of this section, the Mississippi Transportation Commission may transfer and convey to the Itawamba Community College District all right, title and interest in certain real property located in Itawamba County, Mississippi, such property described more particularly as follows:

Commencing at a concrete marker that is recognized as being the Southeast Corner of the Southwest Quarter of Section 36, Township 9 South, Range 8 East, Itawamba County, Mississippi, and thence run South 00 degrees 54 minutes 28 seconds East for a distance of 27.98 feet to an iron pin on the West right-of-way line of the Mississippian Railroad, thence run South 01 degrees 24 minutes 13 seconds East for a distance of 309.48 feet, thence run North 84 degrees 35 minutes 06 seconds West for a distance of 360.66 feet, thence run North 87 degrees 21 minutes 37 seconds West for a distance of 214.13 feet, thence run North 84 degrees 27 minutes 57 seconds West for a distance of 96.90 feet, thence run North 68 degrees 44 minutes 76 seconds West for a distance of 55.10 feet, thence run North 61 degrees 09 minutes 52 seconds West for a distance of 299.75 feet to the Point of Beginning; thence run North 61 degrees 09 minutes 52 seconds West for a distance of 9.53 feet to a point, thence run North 63 degrees 01 minutes 49 seconds West for a distance to 272.77 feet to a point, thence run South 87 degrees 48 minutes 08 seconds West for a distance of 123.98 feet to a point, thence run North 07 degrees 58 minutes 35 seconds West for a distance of 132.00 feet to a point, thence run North 06 degrees 25 minutes 00 seconds West for a distance of 268.00 feet to a point, thence run North 78 degrees 33 minutes 07 seconds East for a distance of 349.83 to a point, thence run South 02 degrees 35 minutes 07 seconds East for a distance of 179.49 feet to a point, thence run South 10 degrees 01 minutes 50 seconds East for a distance of 417.09 feet to the Point of Beginning.

Part lying and being in the Northwest Quarter of Section 1, Township 10 South, Range 8 East and part lying and being in the Southwest Quarter of Section 36, Township 9 South, Range 8 East, Itawamba County, Mississippi, and containing 3.73 acres, more or less.

(b) The conveyance authorized in this subsection (1) may be subject to additional terms and conditions agreed upon by the Mississippi Transportation Commission and the Board of Trustees of the Itawamba Community College District.

(2) (a) In consideration for the conveyance of property authorized in subsection (1) of this section, the Board of Trustees of the Itawamba Community College District, may transfer and convey to the Mississippi Transportation Commission all right, title and interest in certain real property located in Itawamba County, Mississippi, such property described more particularly as follows:

From the intersection of the center line of the pavement on Highway #178 with the East line of Section 25, Township 9 South, Range 8 East, which point is approximately 2390.0 feet South of the Northeast Corner of said Section 25, run North 83 degrees 02 minutes West along the center line of said highway, a distance of 3760.0 feet to highway survey station 187+00, thence run North 02 degrees 32 minutes West to a point 40 feet left from the center line of the highway measured radially from said highway for a Point of Beginning, thence easterly along the north right-of-way of said highway, a distance of 50 feet, thence North 12 degrees 32 minutes East a distance of 484 feet, thence North 82 degrees 45 minutes West for a distance of 229.2 feet, thence South 02 degrees 28 minutes West for a distance of 455.1 feet, thence South 87 degrees 36 minutes East for a distance of 181.8 feet to a point 88 feet left of and measured radially from the center line of Highway 178 at station 187+00, thence South 02 degrees 32 minutes East for a distance of 48 feet to the Point of Beginning.

The aforedescribed parcel of land is a part of Block 13, in the Outside Donation of the Town of Fulton, and in the South 1/2 of the Northwest 1/4 of Section 25, Township 9 South, Range 8 East and contains 2.34 acres, more or less.

(b) The conveyance authorized in this subsection (2) may be subject to additional terms and conditions agreed upon by

the Board of Trustees of the Itawamba Community College District and the Mississippi Transportation Commission.

SECTION 2. This act shall take effect and be in force from and after July 1, 2004, and shall stand repealed from and after June 30, 2004.
