AMENDMENT NO 3 PROPOSED TO

House Concurrent Resolution No.   48

     AMEND by deleting the language beginning with the word "The" on line 21 through the period on line 45 and inserting in lieu thereof the following:

     "The person receiving a majority of the popular votes cast in the election for the office shall be declared elected.

II.

     Amend Section 141, Mississippi Constitution of 1890, to read as follows:

     "Section 141.  If no person * * * receives a majority of the popular votes cast in the election, then the House of Representatives shall proceed to choose a governor from the two persons who shall have received the highest number of popular votes.  The election shall be by viva voce vote, which shall be recorded in the journal, in such manner as to show for whom each member voted."

     AMEND FURTHER by deleting the language beginning after the colon on line 54 and inserting the following in lieu thereof:

     "This proposed constitutional amendment abolishes the electoral vote requirement for the Office of the Governor.  Under the amendment, the person who receives a majority of the popular votes for Governor at the general election shall be declared elected.  If no candidate receives a majority, the House of Representatives will decide the winner from the two candidates who receive the highest number of votes."

     AMEND FURTHER by striking the title in its entirety and inserting the following in lieu thereof:

     "A CONCURRENT RESOLUTION PROPOSING TO AMEND SECTIONS 140 AND 141 OF THE MISSISSIPPI CONSTITUTION OF 1890 TO PROVIDE THAT THE PERSON RECEIVING A MAJORITY OF THE POPULAR VOTES CAST IN THE GENERAL ELECTION FOR THE OFFICE OF GOVERNOR SHALL BE DECLARED ELECTED; TO PROVIDE THAT IF NO CANDIDATE RECEIVES A MAJORITY, THE HOUSE OF REPRESENTATIVES WILL DECIDE THE WINNER FROM THE TWO CANDIDATES WHO RECEIVE THE HIGHEST NUMBER OF VOTES; TO ABOLISH THE REQUIREMENT THAT THE GOVERNOR BE ELECTED BY VOTE OF THE HOUSE OF REPRESENTATIVES IF NO CANDIDATE RECEIVES BOTH A MAJORITY OF THE POPULAR VOTE AND A MAJORITY OF THE ELECTORAL VOTES; AND FOR RELATED PURPOSES."
