AMENDMENT NO 1 PROPOSED TO

Cmte Sub for House Bill No. 1429

     AMEND on line 47 after the word "counties" by deleting the language through the period on line 87 and inserting in lieu thereof the following:  "shall be fixed by the county board of supervisors.  The salary of the tax assessor or tax collector shall not be reduced below the amount that such tax assessor or tax collector was receiving immediately before the effective date of House Bill No. 1429, 2004 Regular Session.  When the board of supervisors of any county increases the salary of the tax assessor or tax collector, the board of supervisors shall increase by the same percentage the salary of all other county officials for which the board of supervisors is authorized by law to establish."

     AMEND FURTHER on line 149 after the word "counties" by deleting the language through the period on line 185 and inserting in lieu thereof the following:  "shall be fixed by the county board of supervisors of the respective county.  The salary of the members of the boards of supervisors shall not be reduced below the amount that such members of the boards of supervisors was receiving immediately before the effective date of House Bill No. 1429, 2004 Regular Session.  When the board of supervisors of any county increases its salary, the board of supervisors shall increase by the same percentage the salary of all other county officials for which the board of supervisors is authorized by law to establish."

     AMEND FURTHER on line 193by deleting "(9)" and inserting in lieu thereof "(10)"

     AMEND FURTHER on line 194 by deleting the language through the period on line 219 and inserting in lieu thereof the following:  "shall be fixed by the county board of supervisors.  The salary of the sheriff shall not be reduced below the amount that such sheriff was receiving immediately before the effective date of House Bill No. 1429, 2004 Regular Session.  When the board of supervisors of any county increases the salary of the sheriff, the board of supervisors shall increase by the same percentage the salary of all other county officials for which the board of supervisors is authorized by law to establish."

     AMEND FURTHER on line 221 by deleting the language after the word "addition" through the language before the first comma on line 222.

     AMEND FURTHER on line 250 by deleting the language after the word "addition" through the language before the first comma on line 251.

     AMEND FURTHER on line 282 by deleting the language after the word "addition" through the language before the comma on line 283.

     AMEND FURTHER on line 286 by deleting the language after the word "addition" through the language before the first comma on line 287.

     AMEND FURTHER on line 291 by deleting the language after the word "addition" through the language before the comma on line 292.

     AMEND FURTHER on line 343 by deleting the language after the word "addition" through the language before the first comma on line 344.

     AMEND FURTHER on line 352 by deleting the language after the word "addition" through the language before the first comma on line 353.

     AMEND FURTHER on line 361 by deleting the language after the word "addition" through the language before the first comma on line 362.

     AMEND FURTHER on line 378 by deleting the language after the word "addition" through the language before the first comma on line 379.

     AMEND FURTHER on line 388 by deleting the language after the "(11)" through the language before the word "shall" and inserting in lieu thereof the following:  "The salary of the sheriff".   

     AMEND FURTHER on line 399 by deleting the language after the "(1)" through the period on line 425 and inserting in lieu thereof the following:  "The salary of a justice court judge shall be fixed by the county board of supervisors in lieu of any and all other fees, costs or compensation heretofore authorized for such justice court judge.  The salary of a justice court judge shall not be reduced below the amount that such justice court judge was receiving immediately before the effective date of House Bill No. 1429, 2004 Regular Session.  When the board of supervisors of any county increases the salary of a justice court judge, the board of supervisors shall increase by the same percentage the salary of all other county officials for which the board of supervisors is authorized by law to establish."

     AMEND FURTHER on line 577 by deleting, after the word "salary", the language before the comma and inserting in lieu thereof the following:  "to be fixed by county board of supervisors".

     AMEND FURTHER after the period on line 587 by inserting the following language:  "The salary of a chief county medical examiner shall not be reduced below the amount that such chief county medical examiner was receiving immediately before the effective date of House Bill No. 1429, 2004 Regular Session.  When the board of supervisors of any county increases the salary of a chief county medical examiner, the board of supervisors shall increase by the same percentage the salary of all other county officials for which the board of supervisors is authorized by law to establish."

     AMEND FURTHER on line 688 by deleting the underlined language on line 688 and inserting in lieu thereof the following:  "to be fixed by the board of supervisors".

     AMEND FURTHER on line 690 after the period by inserting the following language:  "The salary of a riding bailiff shall not be reduced below the amount that such riding bailiff was receiving immediately before the effective date of House Bill No. 1429, 2004 Regular Session.  When the board of supervisors of any county increases the salary of a riding bailiff, the board of supervisors shall increase by the same percentage the salary of all other county officials for which the board of supervisors is authorized by law to establish."

     AMEND FURTHER on line 695 by deleting, after the "(1)" through "$1,800.00" on line 739 and inserting in lieu thereof the following:  "The board of supervisors shall fix the fees that may be charged by a marshal or constable, except as otherwise provided by law."

     AMEND FURTHER on line 741 by deleting the language "under subsection (1) of this".

     AMEND FURTHER on line 1118 after the period by inserting the following language "The compensation of a chancery clerk for performance of the duties required by this section shall not be reduced below the amount that such chancery clerk was receiving immediately before the effective date of House Bill No. 1429, 2004 Regular Session.  When the board of supervisors of any county increases the compensation of a chancery clerk for performance of the duties required by this section, the board of supervisors shall increase by the same percentage the salary of all other county officials for which the board of supervisors is authorized by law to establish."

     AMEND FURTHER on line 1124 by deleting the language after the word "as" through the period on line 1163 and inserting in lieu thereof the following:  "otherwise provided in this section, the salary of the county prosecuting attorney shall be fixed by the county board of supervisors.  The salary of the county prosecuting attorney shall not be reduced below the amount that such county prosecuting attorney was receiving immediately before the effective date of House Bill No. 1429, 2004 Regular Session.  When the board of supervisors of any county increases the salary of the county prosecuting attorney, the board of supervisors shall increase by the same percentage the salary of all other county officials for which the board of supervisors is authorized by law to establish."

     AMEND FURTHER on line 1171by deleting the language before the comma and inserting in lieu thereof the following:  "of the county prosecuting attorney".

     AMEND FURTHER on line 1539after the word "addition" by deleting language before the comma on line 1540.

     AMEND FURTHER the title by deleting language on lines 1 through the semicolon on line 29 and inserting in lieu thereof the following:  

     "AN ACT TO AMEND SECTIONS 25-3-3, 25-3-13, 25-3-25, 25-3-36, 19-25-31, 25-7-27, 25-7-13, 27-105-343, 25-3-9 AND 41-61-59, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT THE COUNTY BOARD OF SUPERVISORS SHALL FIX THE SALARIES OF CERTAIN COUNTY OFFICIALS; TO PROHIBIT THE BOARD OF SUPERVISORS OF A COUNTY FROM REDUCING A COUNTY OFFICIAL'S SALARY BELOW THE AMOUNT THAT SUCH COUNTY OFFICIAL WAS RECEIVING IMMEDIATELY BEFORE THE EFFECTIVE DATE OF THESE PROVISIONS; TO REQUIRE THE BOARD OF SUPERVISORS OF ANY COUNTY TO INCREASE BY THE SAME PERCENTAGE THE SALARY OF ALL OTHER COUNTY OFFICIALS FOR WHICH THE BOARD OF SUPERVISORS IS AUTHORIZED BY LAW TO ESTABLISH WHEN THE BOARD OF SUPERVISORS INCREASES ANY COUNTY OFFICIALS SALARY; TO AMEND SECTION 9-13-19, MISSISSIPPI CODE OF 1972, TO INCREASE THE CIRCUIT CLERK'S FEE FOR EACH DAY'S ATTENDANCE UPON THE CIRCUIT COURT TERM; TO AMEND SECTION 9-1-43, MISSISSIPPI CODE OF 1972, TO REVISE THE SALARY LIMITATION OF THE CHANCERY AND CIRCUIT CLERK;
