REPORT OF CONFERENCE COMMITTEE

 

MADAM PRESIDENT AND MR. SPEAKER:

 

   We, the undersigned conferees, have had under consideration the amendments to the following entitled BILL:

 

S. B. No. 3182:  Appropriation; Attorney General - Judgments, Settlements, Fees; Additional FY 2004.

 

  We, therefore, respectfully submit the following report and recommendation:

 

  1.  That the House recede from its Amendment No. 1.

 

  2.  That the Senate and House adopt the following amendment:

 

     Amend by striking all after the enacting clause and inserting in lieu thereof the following:

 


SECTION 1.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Budget Contingency Fund created in Section 27-103-301, Mississippi Code of 1972, not otherwise appropriated, to defray the expenses of the Office of the Attorney General for the fiscal year ending June 30, 2004$    269,806.00.

     This additional appropriation is made for the purpose of defraying the costs of certain outside legal assistance, expert witness fees and court fees incurred by the Office of the Attorney General.

SECTION 2.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Budget Contingency Fund created in Section 27-103-301, Mississippi Code of 1972, not otherwise appropriated, for the purpose of paying a judgment rendered against the State of Mississippi for the fiscal year ending June 30, 2004$    114,004.00.

     This additional appropriation is made for the purpose of paying a court ordered judgment as required in Civil Action No. 1:02CV20-B-0, Bertha Earnest vs Mississippi Department of Human Services, the United States District Court, Northern District of Mississippi.

SECTION 3.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Budget Contingency Fund created in Section 27-103-301, Mississippi Code of 1972, for the purpose of paying a settlement against the State of Mississippi for the fiscal year ending June 30, 2004....................$   239,570.00

     This additional appropriation is made for the purpose of paying a settlement in Cause No. 2000-CT-00258-SCT; Jimmy B. Callens vs East Mississippi State Hospital, The Mississippi Department of Mental Health, Dr. Ramiro J. Martinez and Roger McMurtry.

SECTION 4.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Budget Contingency Fund created in Section 27-103-301, Mississippi Code of 1972, not otherwise appropriated, for the purpose of paying a judgment rendered against the State of Mississippi for the fiscal year ending June 30, 2004$     22,672.00.

     This additional appropriation is made for the purpose of paying a settlement in Civil Action No. 2:01CV62PG, Stacey Walkers Cooley vs Harrison County Board of Supervisors, in the United States District Court, Southern District of Mississippi.

SECTION 5.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Budget Contingency Fund created in Section 27-103-301, Mississippi Code of 1972, not otherwise appropriated, for the purpose of paying a judgment rendered against the State of Mississippi for the fiscal year ending June 30, 2004$        500.00.

     This additional appropriation is made for the purpose of paying a settlement in Civil Action No. 3:99CV32-W-S; Sheryl Bridges vs Mississippi Department of Corrections, et al, in the United States District Court, Southern District of Mississippi.

SECTION 6.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Budget Contingency Fund created in Section 27-103-301, Mississippi Code of 1972, not otherwise appropriated, for the purpose of paying a judgment rendered against the State of Mississippi for the fiscal year ending June 30, 2004$     60,000.00.

     This additional appropriation is made for the purpose of paying a settlement in Cause No. BC 75-31-S; Mattie T. vs Henry Johnson in the United States District Court for the Northern District of Mississippi.

     SECTION 7.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Office of the Attorney General, which shall be derived from funds transferred to the Office of the Attorney General from Fund No. 3112 and Fund No. 3114, at the discretion of the Secretary of State, for the purpose of paying a settlement against the State of Mississippi for the fiscal year ending June 30, 2004.............................$   1,115,316.00.

     This additional appropriation is made for the purpose of paying a settlement in Civil Action No. 1:92CV20-D-D; J. Randolph Lipscomb, et al vs State of Mississippi, et al, in the United States District Court, Northern District of Mississippi.

SECTION 8.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Budget Contingency Fund created in Section 27-103-301, Mississippi Code of 1972, not otherwise appropriated, to defray the expenses of the Governor's Office - Division of Medicaid for the fiscal year ending June 30, 2004...........................$   3,300,000.00.

     This additional appropriation is made for the purpose of continuing the operation of the Governor's Office - Division of Medicaid for fiscal year 2004.

SECTION 9.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Governor's Office - Division of Medicaid, which is comprised of special source funds collected by or otherwise available to the division, for the purpose of defraying the expenses of the division, for the fiscal year ending June 30, 2004... $ 11,048,000.00.

     This additional appropriation is made for the purpose of defraying the costs of operation for the Governor's Office - Division of Medicaid for fiscal year 2004.

SECTION 10.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Budget Contingency Fund created in Section 27-103-301, Mississippi Code of 1972, not otherwise appropriated, to defray the expenses of the Department of Corrections for the fiscal year ending June 30, 2004..........................................$   19,424,133.00.

     This additional appropriation is made for the purpose of continuing the operation of the Department of Corrections for fiscal year 2004.

     It is the intent of the Legislature that Six Million Eighty-five Thousand Nine Hundred Sixty-one Dollars ($6,085,961.00) be allocated to the University Medical Center as payment for medical services provided.

SECTION 11.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Budget Contingency Fund created in Section 27-103-301, Mississippi Code of 1972, not otherwise appropriated, to defray the expenses of the Department of Human Services for the fiscal year ending June 30, 2004. $   12,000,000.00.

     This additional appropriation is made for the purpose of continuing the operation of the Department of Human Services for fiscal year 2004.

     SECTION 12.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Budget Contingency Fund created in Section 27-103-301, Mississippi Code of 1972, not otherwise appropriated, to defray the expenses of the District Attorneys and Staff for the fiscal year ending June 30, 2004.............................................$   1,052,896.00.

     This additional appropriation is made for the purpose of continuing the operation of the District Attorneys and Staff for fiscal year 2004.

     SECTION 13.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Budget Contingency Fund created in Section 27-103-301, Mississippi Code of 1972, not otherwise appropriated, to defray the expenses of the Governor's Office - Support for the fiscal year ending June 30, 2004 ...........................................$   158,759.00.

     This additional appropriation is made for the purpose of continuing the operation of the Governor's Office - Support for fiscal year 2004.

     SECTION 14.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Budget Contingency Fund created in Section 27-103-301, Mississippi Code of 1972, not otherwise appropriated, to defray the expenses of the Governor's Mansion for the fiscal year ending June 30, 2004

     This additional appropriation is made for the purpose of continuing the operation of the Governor's Mansion for fiscal year 2004.

     SECTION 15.  The money herein appropriated shall be paid by the State Treasurer out of any money in the proper fund or funds as set forth in this act, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person, officer or officers in the manner provided by law.

     SECTION 16.  This act shall take effect and be in force from and after its passage.
