AN ACT TO PROVIDE IMMUNITY FROM SUIT FOR THE OWNER OF PROPERTY AS AGAINST THE OPERATOR OR RIDER OF ANY ALL-TERRAIN VEHICLE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Any person owning or controlling real estate or other premises who, without having received compensation therefor, fails to prevent entry upon the real estate or other premises by a person or persons who are operating or riding upon any all-terrain vehicle, shall not be civilly liable for negligently causing the death of, or injury to, any person on or about such real estate or premises or for loss of, or damage to, the property of such a person.  No cause of action shall lie against a landowner or his successors in interest for damages to an operator of or rider on an all-terrain vehicle while the operator or rider are on such lands unless the damage is caused by the intentional tortious conduct of the landowner or his agent.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2004.
