AN ACT TO CODIFY SECTION 97-15-28, MISSISSIPPI CODE OF 1972, TO CREATE THE MISDEMEANOR OF LITTERING BY COMMERCIAL SOLID WASTES HAULERS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The following shall be codified as Section 97-15-28, Mississippi Code of 1972:

     97-15-28.  (1)  Trucks or other vehicles engaged in hauling solid wastes for economic gain shall be so covered, secured or sealed that there will be no loss during haulage to cause littering of streets or highways or cause a nuisance or hazard to the public health.

     (2)  For the purposes of this section, the term "solid wastes" shall have the meaning ascribed in Section 17-17-3.

     (3)  Any person who violates this section is guilty of a misdemeanor and subject to a fine of not more than Five Hundred Dollars ($500.00), imprisonment not to exceed thirty (30) days, or both.

     (4)  It shall be the duty of all law enforcement officers to enforce the provisions of this section.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2004.
