AN ACT TO PROHIBIT POLLING OF THE JURY BY NAME; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  If upon inquiry of the court, either party to a proceeding desires to poll the jury, or the court on its own motion desires to poll the jury, the poll shall be conducted by juror number or letter or other designation; the name of the juror shall not be called in open court.

     (2)  Failure to comply with this section shall not nullify any proceeding, but shall subject the person violating the prohibition to contempt of court upon the motion of any interested person, including a juror.

     SECTION 2.  This act shall be codified in Title 13, Chapter 5, Mississippi Code of 1972.

     SECTION 3.  This act shall take effect and be in force from and after its passage.
