House Bill 1304

AN ACT TO AMEND SECTION 37-11-23, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT A PRINCIPAL OR ANY OTHER SCHOOL ADMINISTRATIVE OFFICIAL MAY REMOVE FROM SCHOOL PROPERTY ANY PERSON WHO WILFULLY DISTURBS ANY SESSION OF THE PUBLIC SCHOOLS OR ANY PUBLIC SCHOOL MEETING; TO INCREASE THE FINE FOR ANY PERSON WHO WILFULLY DISTURBS ANY SESSION OF THE PUBLIC SCHOOLS OR ANY PUBLIC SCHOOL MEETING; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 37-11-23, Mississippi Code of 1972, is amended as follows:

     37-11-23.  (1)  A principal or any other school administrative official may remove from school property any person who wilfully disturbs any session of the public schools or any public school meeting.

     (2)  If any person * * * wilfully disturbs any session of the public schools or any public school meeting, that person shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not less than Fifty Dollars ($50.00) nor more than Five Hundred Dollars ($500.00).

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2004.
