AN ACT TO AMEND SECTION 63-3-207, MISSISSIPPI CODE OF 1972, TO REQUIRE PERSONS UNDER THE AGE OF 18 YEARS TO WEAR HELMETS WHILE RIDING BICYCLES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 63-3-207, Mississippi Code of 1972, is amended as follows:

     63-3-207.  (1)  Every person riding a bicycle or an animal or driving any animal drawing a vehicle upon a highway shall have all of the rights and all of the duties applicable to the driver of a vehicle under this chapter, except those provisions of this chapter which by their nature can have no application.

     (2)  Every person under the age of eighteen (18) years shall be required to wear a helmet when riding a bicycle on any public roadway or municipal sidewalk.  A violation of the provisions of this subsection is punishable by a fine of not less than Twenty-five Dollars ($25.00) nor more than Forty Dollars ($40.00) to be assessed against the parent or guardian of such child in violation of this subsection.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2004.
