House Bill 1205

AN ACT TO REQUIRE LAW ENFORCEMENT AGENCIES TO KEEP PERMANENT RECORDS OF ALL CRIMINAL CASES UNTIL APPLICABLE LIMITATIONS EXPIRE; TO PROVIDE THAT THIS ACT SHALL BE SUPPLEMENTAL TO THE PROVISIONS OF LAW RELATED TO THE JUSTICE INFORMATION CENTER; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Every law enforcement agency in the state shall keep and maintain permanent records of all criminal cases in the agency's jurisdiction until all applicable statutes of limitation shall have expired.  If a record involves a crime for which there is no time limitation for prosecution, the law enforcement agency shall not destroy such record.  The provisions of this section shall be supplemental to the provisions of Sections 45-27-1 through 45-27-19 which provide for record keeping by the Justice Information Center.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2004.
