AN ACT TO REQUIRE A PERSON WHO USES A CREDIT CARD OR DEBIT CARD TO PURCHASE GOODS OR SERVICES TO SHOW THE SELLER OR SELLER'S AGENT PHOTO IDENTIFICATION BEFORE THE PURCHASER MAY USE THE CREDIT CARD OR DEBIT CARD FOR THE PURCHASE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  Any person who physically presents a credit card or debit card to another person at the point of sale for the purpose of purchasing goods or services must show the seller or seller's agent a valid driver's license with a photograph of the purchaser or some other photographic identification of the purchaser to verify that the purchaser is the cardholder, before the purchaser may use the credit card or debit card for the purchase.

     (2)  This section shall not apply to transactions in which the purchaser uses credit card or debit card information to make a purchase of goods or services by mail, telephone, Internet or some other means where the purchaser is not in the same physical location as the seller or seller's agent, and the seller or seller's agent cannot physically check an identification card of the purchaser.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2004.
